fake identity

whether and what penal provisions of informatiom technology act will be attracted,, if a person submits his fake identity proof while purchasing a new mobile connection?? if above provisions are not attracted then plz refer the relevant provisions and acts in this regard..

What is affidavit?
Does it have to be typed on stamp paper? of how much?
does it have to be notarized?
outside court, there are many advocates that ask variable amount for it? what is actual fees?
how to get it done within the actual fees?

cyber evidence

sir ,conversation bw my fatherin law who has threatened me thro mobile but it could be recorded, and he has sent some sms to his daughter which is important document but she deleted it. can we get conversation record or sms from mobile company now? if it comes thro legal direction can we get documents and recordings from company? pls give me valid and authenticatred reply as i didnt get proper reply from anybody regarding cyber evidence of getting sms and call conversation from company.

Quere regarding giving payment in cash and receiving by cheq

Dear Experts,

Suppose Mr. X has given Rs. 30000 in cash to his Friend and now the friend is not in position to return money so his relative ie father makes the payment to Mr. X in part payments say Rs 5000 each time by making cheque payment.

here mr.X has paid in cash but has received money by cheque from father of his friend

so now can there be situation that father of friend of Mr.X may again demand money by saying that me has made payment
Can there be legal complications

and what is the right way to accept money

Procedue for becoming Lawyer/Notary???

Hi,

I am Amit Arora, aged about 27 Years, working in a MNC in Gurgaon (Haryana) - have completed my B.Com & MBA (Finance) through distance learning programe.

I have keen interest in the Law. Can someone suggest me the procedure for becoming the lawyer & Notary. Is it possible to study through distance learning programme or a regular collage is mandatory for studying law.
I want to study along with my joB.

Please suggest me law collages in Delhi/NCR and also give me more information/guide me how to proceed further.

Conviction under two Acta for same offence



The sessions Court has convicted and sentenced 8 accused as under :

1. for offences under Ss. 302/149 IPC - life imprisonment + penalty rs 3000/- each

2. for offences under Ss.3/2/5 SC ST Act - life imprisonment + penalty rs 2000/- each

3. for offence under s. 146 IPC - one year regorous imprisonment

The appeal is being listed for final hearing before the high court.
Now, s. 26 of the General Clauses Act provides for "...prosecution and punishment under either or any of those enactments but not to be punished twice for the same offence." Is this provision helpful to me , if yes, in what manner and what should be my line of argument ?

maintenance under section 125

Sir, I would like to know abt the maintenance under section 125 of CRPC. I got married on March-08. My wife is not living with me since December 08 (more than one year). She is under the misguidance of her Family. She is well qualified and did M.A ENG & Political & B.Ed from a reputed institute I made all efforts to come back social & Legal I filed a sec. 9 a comp. in Aug 09 after that they impose false allegation of dowry & DOM VOL. & filed a case of maintence under section 125 CRPC IN IT She demanded INR 25000 PM What can I do to avoid maintance . Plz suggest me.There is no issue.

method for action against complaint

Hello,

As you all know that I am having matrimonial dispute with my wife for past 3 yrs.

Just 60 days before, I have given one complaint at police station against my in-laws that ".....they are coming to my work place carring knives, asking/enquiring about me.....etc...these all things are told by my work place neighbours"

After some time I filed an RTI application and ask for action taken report.

In reply they said
"NO ACTION HAS BEEN TAKEN SINCE IT IS NOT A CONGNIZABLE OFFENCE"

What should I do, so that the police must take some action on that complaint.
