sale of property without owner's consent

Greetings!
My Grandfather had 3 sons and 5 daughters.My Mother is the second of the 5 daughters.He passed away 8 years before.I have married My mothers elder brothers only daughter( My elder Uncle's daughter ).After my grandfathers death my second uncle took possesion of all the documents related to the property left by my grandpa.My grandma also owns some immovable property for which also the papers are in the possesion of my second uncle.The property had not been partioned yet.But we are now coming to know that he is trying to sell the lands both of my grandpa's and my grandma's without the consent of all others.
also my father in law has passed away before my grandpa. hence my wife, my mother in law and her mentally challenged son ( age 25 ) have been denied on their rights and my 2nd uncle has taken a legal heir certificate excluding my father in law, my mother in law, my wife and my brother in law. My queries are
is there a way that i could get a legal heir certificate changed including all their names?
is it possible that he can sell off the lands without our consent just because he is holding the land documents?
is there a way legally and simple that we could stop him?

cheque return

Whether court can ignor to award interest on original amount when makes order to pay amount of cheque in a proven case? is it not compulsory to award interest till the date of payment in negotiable instruement Act?

Limitation of 138 N.I.Act

Sir,
I have presented the cheque three times in the bank on the request of the drawer but each time that was dishonord by his bank. Lastly I sended over him a legal notice within the limitation (within 30 days of last bank MEMO) and after that I file the suit in court under the limitation but I have mentioned the reference of all the dates in the Suit. Is it illegal ?. From when the limitation will start runing either First dishonor or the from first notice Kindly sugess.

138 NI case-Marking of exhibit.

1. The list of documents in notice and complaint does not carry three new documents that were marked.
2. The magistrate after marking got my counsel to sign the 'Memo filed by Complainant' which was dated the previous day, and my counsel signed it 'under objection' but did not date it. Was it right?
3. The Magistrate, marked a document that was titled 'Memorandum of Deposit of Title Deed'. My counsel objected that the said document was not stamped or registered, hence it should not be marked. The magistrate proceeded and marked it without registering his objection. Is it correct? Should I file a memo or something to his court office? The next hearing is almost 20 days away, won't it lose its tenacity?

notice had been sended u/s 138 N.i.Act but the name of the bank has been wrongly mentioned, again a notice has been sended for clearification that read the name of the bank so and so in place of so and so in the original notice. is it legally correct?

JMFC court has in a case send the arested accused on three days remand while the person was booked under bailable section of IPC was this action of the JMFC justified
