Dear sir,
please guide me.....
There is a issue regarding full & final settlement claim after resigning a job. I joined a company in May'13 and resigned a job in Ma'14.
In my offer letter, there was a clause for performance incentive-entitlement of performance incentive could vary based on individual performance and paid to confirmed employees only.
After that in my appointment letter, there was a clause for performance incentive-entitlement of performance incentive would depend on company as well as individual performance and will be payable to those who continue to be on rolls till 31st mar of each year and will be paid after completion of the appraisal process.
Sir, my query is that...
1) There is any remedy for me to claim performance incentive because at the time of offer letter they are not told me about the condition of PI as per appointment letter.
2)I also worked late hours, which is also not paid to me. There is any guidelines for late hours working in the labour law for harassed persons.
Please sir, help me....

In other words one suit and one decision is enough for a single dispute.
OBJECTIVES

2.IT IS THE INTEREST OF THE STATE THERE SHOULD BE AN END OF LITIGATION
3.A JUDICIAL DECISION MUST BE ACCEPTED AS CORRECT,
NOW MY QUESTION IS

Sirs,
At Tamil Nadu, in our village we have purchased one property 50 years back, where in 1999 we have constructed home by taking bank loan base document is VAO's (Village Administrative Officer) certificate. The land owner is expired in 1982 who is my uncle (i.e., my father's sisters husband). That time they lived as joint family. My father is alive now he is 75 years old. The biggest mistake my father was done is that the land was not registered then purchased time.
In 2012 I have made some payment to uncle's kin for making purchase registration.
Now after taking payment from me,the kins are turned our and informing they would not do the registration, so i went to court filed the case against them, they non of them is resident of our village (local address). Please give proper advice to me.

Hello Experts,
In front of my house my neighbor had build recently Ground + 4 floors by taking only ground and first floor permission from GHMC (Grater Hyderabad Municipal Corporation) three floors had been built illegally by not leaving open space for setbacks and parking area for parking vehicles.
Six months back I had given compliant to GHMC against our neighbor because of parking of vehicles in front of my house, after requesting to him to not to park the vehicles in front of my house, but he was not lessening to me and told me that I will park the vehicles here itself and do whatever you want to do.
GHMC people had inspected the site they had issued the notice and in these regard he had filed the case in city civil court and got stay order and now completed his house construction, GHMC also filed case against to him.
Now the matter is in the court and both lawyers (I.e. GHMC & my neighbor) had reached to one understanding of compromise and accordingly they are following, in these regard I would like to know whether court in his judgment will direct my neighbor to leave open space for setbacks and parking area for parking vehicles, as he had already build rooms in ground floor and accordingly he had built same thing in upper floors.
Else shall I file the case against them to get the judgment with in time frame and to follow building rules & regulations according to GHMC.
Expenditure incurred to me for fitting the case, his recoverable from GHMC or not please inform for which I am very thankful to you.

Hi,
I am the petitioner. I got exparte order on a civil recovery case. Now after 90 days, the defendant filed petition to reopen the case. i have strong proofs that he was lying for the delay. I already mentioned these in our counter. At the same time we asked for 50% of the order amount to be deposited, if the court decides to condone the delay and reopen the case. Will this amount be acceptable to court? In general what is the acceptable amount as percentage of the order amount?
Thanks in advance.

Hi,
I am the petitioner in a civil recovery case. So far we filed evidence affidavit and waiting for cross examination. After this, I would like appoint some one on my behalf through proper Power of Attorney to attend the court, as I would be travelling. Is it possible? How far I would be responsible for all things done by this Attorney, other than the outcome of this case?
Thanks in advance.

Letters patent appeal abolition
Hi I just came across THE MAHARASHTRA HIGH COURT (HEARING OF WRIT PETITIONS BY DIVISION BENCH AND ABOLITION OF LETTERS PATENT APPEALS) ACT, 1986 which came into force from 18th March 2013.
As per my reading u/s 3 of the Act appeals from under any statute instituted or commenced, whether before or after the commencement of this Act, shall lie to the High Court from a judgment, decree or order of a Single
Judge of the High Court made on or after the commencement of this Act, whether in the exercise of
the original or appellate jurisdiction of the High Court.
hence in such a case an appeal against an order to conditional leave to defend will lie to the Supreme Court and not to the Division Bench of the Hon'ble Bombay High Court?
Please help..!!
