A is husband and B is wife both are married as per Hindu vedic law. Wife filed suit against husband under The Protection of Women from Domestic Violence Act 2005.Now,question husband created Trust.husband make property in the his lifetime in the name of trust; can wife claim on that property?if yes please suggest me case laws.

Recently I lost my brand new mobile phone, which I hardly used for one week. Someone stole it from pocket in crowded Dadar market. I went to Shivaji Park police station and they registered a complaint and gave me a copy for obtaining new sim card.
I also gave them the IMEI number of the mobile, but they are not co-operating for finding the phone as they say it is not possible. If someone come and returns the phone, then they will call me. Their senior had lost one 32000 cost phone, but they could not find.
As I know if someone uses another sim card on same phone, then service provider can trace the phone. When I asked them the same, they said daily 10-15 mobile phone loss cases come. They can't do anything.
Please suggest what should I do. They are also not ready to file FIR.

I recently shifted to our newly acquired rented house with my small kids. but to our shock, the house is full of centipedes and cockroaches. Now we don't want to live here. So,pls suggest if I can claim back the total money spent in paying the middleman, shifting and electric fixtures etc from the Land Lord.

Hi to all,
This is regarding my nephew whose dob on passport and 10th certificate dont match,reason is his passport was made when he was in 6th class and he facing trouble when he is looking to go aboard as passport and 10th dob vary...
PS:someone suggested that we should surrender old passport and reapply for a new one ,with 10th certificate. IS IT POSSIBLE .

My parents own multiple ancestral properties in Maharashtra. However, all of them are in some or the other dispute.
Now, we stay in Gujarat since 30 years. Is it practical to appoint a law firm, in Gujarat, which handles all our legal matters in Maharashtra, or should we appoint a local law firm in Maharashtra? Which would be more viable?
Please help me understand the benefits and drawbacks of both.

Respected Sir,
I borrowed money from a money lender in six instalments spread over year 2012 under an agreement on a stamp paper of the value Rs 100 and issued four undated cheque amounting to the total value of the borrowing.
Since then, till Dec 2013, i have repaid almost double the amount to the lender. The loan was received in cash and the repayment was also made in cash. No record for repayment apart from a few phone call recordings where money lender is acknowledging the reciept of various cash repayments. He is not returning my cheques. Now, the lender is bent on creating nuisance threatening me & family with abduction, murder and applying all sort of pressure tactics to extract more out of me. I have written to local & higher police authorities briefing them on the matter. A meeting was also held in presence of respectable people of the society last month where the members from both sides listened to both sides plea and directed the borrower not to bother me in the future. but he he is still not mending his ways.

With folded hands I seek your valuable advise and guidance on the following position :
The Owner of a plot and the residential house Builder entered into a Collaboration Agreement between both them stating that the Builder shall construct the Building with two flats (ground floor) and first floor flat and the Builder shall take the Second Floor (with Roof Rights) for his consideration of the Collaboration Agreement. Further, the agreement stipulates that the builder shall arrange funds from his sources. The Buillder approaches me and enters into an Agrement to Sell for Second Floor Flat (with roof rights) and starting taking money as planned. Practically, Builder does not completes the Construction and fulfill the responsibilities under the Agreement. The Owner of the plot takes possession of the Second Floor Flat which is planned to be given to the Builder as a consideration for construction of the Building. The Collaboration Agreement is not registered with the concerned Authority at the time when it was executed.
The owner filed a complaint with Police Station for not having completed the work in time. A three month's extention time was mutually agreed between the Owner and the Builder. The Owner was not happy and did not pay any heed to the request of the Builder. The builder filed a case in court of law for claiming possession under specific perfomrance of the agreement. I have paid more than what was scheduled to be paid under the "Agreement to Sell" and the balance was to be paid on complete and satisfactory transfer of the flat, which the Builder did not do. I was a loser and had to move forward to the gain possession of flat in whatever possession.
Since the work was not complete, the owner was also in touch with me. He opined that you take the possession. I moved into the flat and complete the remaining major work and incurred lacs of rupees. On the first date of hearing the case filed by The Builder against the Owner, I filed an application under section 1/10 of CPC for allowing me to make my submssions before the court. The Builder expired after filing the case in the court. The legal representatives have requested the court to be a party to the Case.
What is my status under section 1/10 of CPC under the above circumstances.
The case is titled between the Builder and the Owner. Should I also file a case against the Builder and Owner to consolidate my position.
Major Question : In case the Owner of the Building sells the newly constructed building, will the transfer of Title be genuine to the purchase. Shall I face difficulty in case the new purchaser asks me to get out of the top floor (second floor) Please advise no one can pass a better title than one has.
For your information, the owner has executed a general power of attorney in my name before the first date of hearing of the case filed by the Builder.
Please explain the scope of the Floor with Roof Rights.
Your valuable advice is solicited and this would help me in forming my course of action in the above case.
Dhr is to be file an ep against jdr and jdr is employee in postal department. Which benefits are to be attach under sec 60 CPC. The jdr supernuation is July 31,2014. Pl. give advise in brief .

Kindly advice me about a case :
If any body is a Director of a Private Limited Company, and obtain DIN and operated the company from last three years, and now in 2013 he got Government Service in Eastern Coalfields Limited as an Accountant but he has not resigned from the post of Director and still he is a Director of his Company, as the Company is not doing the business it is about to close but my question is that is it violation of Law that a person engaged in Government Service as well as can he become a Director of Private Limited Company and if yes then what is the process of surrender of DIN, as well as kindly inform me under which Law it is violated the Law.

Property given on rent...
Hello,
A purchased a 50 % undivided share of a property from legal heir X where legal heir X and Y were the owners of the property.
In 2 months time A makes construction on the property and wants to give the property on rent without the permission of Y the co owner of the property both for construction and for giving on rent.
a)How can Y stop A from any construction of the property and how.
b)Will the tenancy agreement done by A be binding on Y too.
c)Can Y stop A from giving the property on rent and how.
d)Will there be any criminal liability on A too.
