I am residing in a flat managed by a residents welfare Association. The Maintenance Charge is collected on fixed basis as per resolution passed in AGM against TNAO Act (Sec19-1) which says the expenses shall be shared on UDS basis. Is it legally valid or correct? Can the bye-law Or resolution of the Assn go against the TNAO Act? - Paulraj
On 10th Oct i gave my shop on rent, with 50000 fixed deposit, we have an informal written agreement for 11 months, after the first month he didn't pay rent, make the excuse that he didn't earn that much as they start, i reply no issue pay next month, he only pays utility. Nov, Dec, Jan he didn't pay rent, now from this month i have to their utility. i have already invested 50,000 on the maintenance of the building.
I want to vacant my property, but i can't pay the balance amount, i want to block their fixed deposit till the original expiry date of the agreement, can i do this...? or what should i do...?

My husband(& other members of joint family) is a tenant of a commercial property in Delhi. It is a pagdi property rented by his grandfather before 1950. Recently, the present landlord filed for eviction on bonafide grounds and rent controller passed eviction order. We filed for a review to the rent controller. The
hearings are still going on regarding the review. The eviction date is almost reached even though the date for hearing of review is later.
I want to know that if the review decision is against the tenant, then would it call for immediate eviction without any further time limit or is there any provision to push the deadline to accomodate the delay in review decision and to allow time for appeal to high court?

My uncle was in police he had two wives ..he did his second marriage without giving divorce to his first wife .he has one son from first wife and two sons from second wife..after some time of his second marriage.his first wife also started living with some other man and it has been so many years she is living with his new partner with her son …now my uncle is passed away in an accident..he was in service ..now the main problem arises..
When police department asked about my uncle’s legal heirs for pension and compensatory appointment in job his first son (from first wife) also claimed the job and first wife claimed the pension and provident fund ..because in the service record of my uncle still first wife’s name is mentioned ..
Now department has stopped all benefits like pension,fund,appointment etc..
The house of my uncle is registered in name of second wife ..
There is no proof of divorce of first marriage and no proof of second marriage (no photos ,registration etc) .
First wife is living with someone else but second wife and her children have no source of income and money to survive ..please guide what can be done in this case so my uncle’s second wife and her children can get something to survive ..and who will get my uncle’s pension and other benefits..

Brief of Case:

My Grandma had one-acre agricultural land in our village. She had given a “right to plow” to a person. (it is a lease kind of thing) We can call it as “Lease”. She DID NOT give her consent in a written document. It was only an ORAL SETUP. For more than 25 that person is doing agriculture and giving a small amount as “lease payment”. There is no receipt for that.
Two important points to note are that “there was NO written agreement between my Grandma and the person who is doing agricultural work and secondly, there is NO RECEIPT for the Lease payment”. Now we want to sell the land to a third person. Now the person who is doing agricultural work is not accepting the sale even though we are READY to pay him 30% of the sale amount.
My Question:

1) Kindly advise me as to what to do next to vacate him from the agricultural land?
2) Is there any possibility to vacate him without a prolonged LEGAL BATTLE?

I have filed a petition for fair rent u/s - 17(6) of the west Bengal Premises Act in 2014 before the Additional Rent Controller at Alipur judges Court, Kolkata. The opposite party is my tenant. The matter is still as of date pending since 2014. The hearing date was fixed several times. But due to reasons like the opposite party was sick, the post of the ARC was vacant for a long time, then covid - 19 pandemic, till date the hearing never happened.
Further more, the tenant has not deposited any rent ( the previous rent amount) since 2014, nevertheless, he is enjoying all the amenities as a tenant. What action can I initiate as the petitioner /landlord in this stage, so that he tenders the previous rent amount with the Rent Controller, as the case is pending with the additional rent controller, Judges court at Alipore, Kolkata.
Ancestral property
My father bought land and registered it in my name when I was a minor. My father died 2 years back but made sure all property was divided between 3 sons. This particular property which is in my name was allotted to me during property division mutually agreed upon between siblings, so no more registration or documentation was done for this land. All other properties which were allotted to my brothers were transferred to them and I signed the documents. Now my brothers are threatening to share this particular property with them else they will go legal as it was registered in my name when I was a minor. How to handle this?
