Ancestral property case (hindu law)

Sir/Madam,
A person married without giving divorce to her wife and living separately from 9 years and isn't giving any maintenance to his children and wife.The ancestral property is divided among son's equally.A part of share is sold by the person without knowing to his wife or children.So the children(son and daughter) being major filed a case against father for share in ancestral property.

Is it correct to file a petition in the same case by his wife asking for her share from husband's share and if she can claim then,what is the percentage of share she may get after partition from husband's share.

Please answer to my query and give suggestions to proceed further according to Hindu Law.

Purchase of open plot

Dear Sir, I would like to purchase a open plot whose owner is died on 18-11-1998. The plot owner is survived by his mother, wife, two married daughters and one married son. On 16-06-2012, the said plot was registered by way of Gift Settlement Deed in favour his two married daughters by his wife and one married son by producing the death certificate of the plot owner. The two married daughters and one married son are having minor children now (all are about having below 8 years old). The plot owner mother is living separately and is not having good relations with the plot owner’s other family members i.e. his wife, daughters and son. Can I purchase the said plot. Are there any legal problems in future from the plot owner’s mother or grand children or from any other angle. Please advise.

Civil revision petition

Sir, Can u advise when the petition for divorce is dismissed (Uncontested) by Subordinate Judge, whether the petitioner has to file Civil Revision Petition at High Court or District Court. The petitioner-wife filed 498A case against the petitioner and his family. The petitioners' family were acquitted, inspite of this mental cruelty, the subordinate judge has dismissed the petition with uncontested. Pls give me appropriate guidance.

Land acquisition

Land was acquired and award was passed the matter wAs referred to civil court. The court enhanced the compensation. The matter was carried in appeal however the same was dismissed the order of the lower court has become final. In the mean some third parties claiming to be owners obtained a decree against the corporation who acquired the land that. They are the absolute owners of the land against which appeal is also pending. In the mean time original claimants have preferred ep and the was ordered. Unfortunately in none of the proceedings before the court the claim of the third parties is brought to the notice of the execution court. Now the apprehension of the corporation is that if the amount is paid as per the orders in ep to the claimants if tomorrow these third parties claim the said amount they will have to pay double the amount for the land acquired. In this situation is it advisable to give a notice to the third parties that we are paying the compensation to the claimants.

Suit for recovery against a deceased, name and whereabout not known of legal heirs

Respected Sirs,
A loan is given to a borrower Named X, a married person, in Govt Service. The borrower expires by committing suicide. When contacted to the Govt department under RTI to know to whom the dues of late X was given and whether anyone is given service at his place, Information was denied stating under RTI, no information is given to a body corporate in spite of sending copy of decision of CIC (CENTRAL INFORMATION COMMISSION Complaint Nos.CIC/WB/C/2007/00104 & 105 both dated 30.3.2007
Right to Information Act 2005 – Section 18 Appellant - Shri J.C. Talukdar Respondent - C.E. (E), CPWD, Kolkata).
The name of widow mother (not whereabout) of late X is with us, but we have not names as well as whereabout of other legal heirs i.e wife or children if any. The home in which Late X used to live with his widow mother and wife was in the name of Late X. That house approx. about 50 lacs is still in the name of Late X at the record of Jaipur Development Authority at its web site. The house was locked and no neighbor is ready to talk about the remaining family and the said story is in office of late X, nobody wants to give any information. The limitation of 3 years is about to expire very shortly.

Now my queries are as under:
1. whether the above mentioned order of CIC was overruled, if yes, please ruling?
2. Whether a recovery suit can be filed only in the name of mother (as legal heir class I) addressing the closed house of late X ?
3. Any way of find the name and address of wife of late X and if not found, what is the remedy if not found ?
4. Any other remedy to recover the amount of loan, as the house is still in the name of late X, since as per law whosoever will take the house is liable to pay his dues also?

In civil suit plaintiff files false affidavit,false documents ,
1- should I file application u/s 304 in the same court as case is pending.
or
2- should I have to file u/s 200 in criminal court.pl advice

Proving common road

Hi Sir/madam

My Inlaws have purchased a corner land 25 years ago and the owner has registered the land by allowing 5 feet passage to the only connectivity road (300 mtrs)in the deed.

Now the kins of the owner has developed the plots on either side of the 300 mtrs road and the road is also been tarred by BBMP (city corporation)

The kins of the owner claiming that, the road belongs to them and my inlaws are allowed to use only 5 feet road ( restricting the Car to come in the road.

Please advise, how to claim our rights to use the road fully.

Requesting guidance on execution application

Respected Experts,

my humble pranams

I have filed Execution petition before the District Consumer forum

after few hearings the JD came and show that the JD applied appeal

so the Judge pending the execution case and later disposed of.

now the state commission appeal is infavour of me so i would like to restore the Execution application again.

Kindly guide me how i can restore the Execution Application

What i have to submit to restore the Execution application.

Rights of tribal people of their land

what are the rights of tribal people regarding their land. As J.P industry has built its number of projects in Kinnaur district (ST Region) of Himachal Pradesh leaving the beautiful place with dirt and ecological imbalances. Due to the construction, roads conditions have become worse and the landslides have common in the area. Even though govt gives consent for the projects but the innocent villagers are manipulated to give their consent. i would like to know about their rights and what can be the appropriate steps to be take so that i can help my people to save our land, its unique culture and its beauty.
