Partition property to the legal heirs

A will written by the husband for his property to her first and second wife. Will came in force after his death. No dispute against the will and the will property was shared according to the will. Sons of the first and second wife received the will property according to the A and B schedule of will. Patta changed in their names and sold the will property against their share leaving only 17 cents punja land by the first wife son. Now the first wife's son files a suit for partition without disputing will for equal share. Whether the suit is maintainable at this stage where the suit properties are in the hands of 3rd party possession. More over will property were already partitioned. Is there one more partition eligible.

Defendants not filing affidavit of evidence in civil suit

Madam/Sirs,
In civil suit original side. Defendants have already filed their respective affidavits of written statements at earlier dates. At present the matter is on evidence stage. Evidence and cross examination of Plaintiff is over.

Court passed order and gave tentative date to defendants for filing their affidavits of evidence. If Defendants do not file Affidavits of evidence despite the Court order. (Since officers of the Defendant Company are aware that the written statements filed earlier is false submissions, probably they do not want to get into further trouble by filing again affidavit of evidence on the same lines.

In this case, what next step the Hon'ble Court will take and the Plaintiff should press for before court ?

Land site owner cheated advance amount 10 lakh rupees

Hello Experts,

I am Bhaskar from Bangalore, My dad saved 10 lakhs from hard working 20 years. We have seen a land in Bashyam Nagar (Near Prakash Nagar,Bangalore) of total Land Area 749 SQFT(Includes 2 Small damaged house and vacant land). We got to know about this land through 2 brokers Vari and Viji, Land Owner Dasaratha agreed to sale this 749 SQFT land for rupees 39,50000/- advance amount rupees 10 lakhs(5 lakhs in cash + 5 Lakhs by Cheque) we paid to Dasaratha and His friend suresh(Witness as well for Dasaratha end). We paid amount on 6th August 2014 and after 1 month we got to know somebody occupied one of that broken house stating we need 50% share on this house and legally they have sent notice(litigation) to Dasaratha lodged a local police compliant. We got shocked about this and asked Dasaratha to pay back our agreement amount 10 lakhs, he kept on promising that I will pay in 1 week, months..... He didn't paid at all. We want to legally take action on him to return our 10 Lakhs rupees. I want to know how many months that agreement is valid? Family is in complete depression. We don't have any support politically or Locally. we would like to take this case legally only. Need your valuable suggestions as early as possible.

we have documents like

1. Agreement copy Original with hand written from Dasaratha signature on each agreement paper.

2.Recorded Voices of his false promises.
