Court fee in suit for declaration with consequential relief

Dear Experts,

THis is Vinod Yadav Advocate from faridabad.

I defending a suit in which sale deed was executed in favour of defendant after a payment of 20 % and remaining payment cheques got dishonoured.

now we are claiming, that sale deed should be null and void as without total consideration fee.

defendants are raising their objection about court fee in this suit.

I have heard that we have not to pay court fee in case of cheque bounce as sale deed is without consideration and our suit is with "consequential relief".


is there any citation in this regard?????

Non submission of lrs within time period

Sir,
I am defendant of one Civil suit lying pending with ADJ, Delhi (TH Court). We were three defendants in this case. Firstly one of the defendant who was my youngest brother died in 2011 and Plaintiff of the suit filled his LRs as per rules. Later one another Defendant (my second Brother) also died in 2013, but his LRs were not filled by the Plaintiff in court. It was raised by Honble Judge on last hearing i.e. on 12.02.2014 that LRs were not filled. Now, Plaintiff filled application and Council for Plaintiff submitted that due to his mistake LRs were not filled time limit. Now we have to submit WS.

Please advise what action will be taken now by the ADJ, some one told me that now this case will be abated ro will be dismissed, non submission of LRs is not an easy issue.


Please advise, also advise any reliance which I have to filled for dismissial of this case.

What to do if my slp is rejected in supreme court

Dear sir,

my SLP is rejected by supreme court recently by speaking orders ' heard counsel at length & we find no reason to differ with the view taken by high court. however the judgement of high court is wrong and not on the facts as no substantial questions raised and on which the appeal was accepted are not answered.

Please advice what i should do next.

Elections in a co-op society

Dear All,



The tenure of the Managing Committee is due to end on 31/03/2015. Can anyone please tell me what is the status of the elections procedure to be held in a Co-op Hsg Society. Ours is a small society consisting of 20 members. Whether the Registrar is to be appointed or the elections are to be done in a normal way?

Divorce

Hello Friends!
I got married 6 years back under the Maharashtra Special Marriage Act as well the same day got married as per Islamic marriage.

Me and my partner are not together since 3 years and we both agree to get seperated.

Questions
1) Can I do a 2nd marriage without giving divoce.
2) Will my special marriage under India Law will be null and void as I also married as per the Muslim Law.
3) Is there a way of Annulement or to void the marriage done under the INdian law.

query related to rented shop

Dear Sir,

I am running one rented shop (general store) since 1959 approx. at that time rent was very nominal amt. In year 2010 our landlord hike the rent amount. we are agreed & paying that. He also issue us in the year 2010 a affidavit mentioning that (1) My father is running that rented shop jointly/along with my uncle,my younger brother & mine since 1959. (2) rent amt. without any clause of increment of rent in future. (3) No objection in case of we applied for MCD licence, Electricity connection etc.

The rent receipt was issued till now in my father's name.

We have also paid our land lord two lakh rupees through cheque in f/o him, his wife & his father's name. without mentioning any type of security/pagri in this affidavit.

Now, the situation is as follows:

1. our landlord expired few years ago. & we paying rent to his wife with @10% increment after 3 years.
2. My uncle was expired few years ago & my father was also expired two month ago.

3. Now, I want the rent receipt in my brothers name.

please advise us what type of problems/complication can be arise/ask by our landlord's wife along with solutions for that.

Gpa cancelled after sale deed

Hi to all,
i am the owner of a immovable property through reg sale deed from a reg GPA dated 2011. now in 2015 i plan to sale that property i applied for EC, i was shocked to see three new entries after my entry of Sale deed date 2011 are reflecting in it -
1) reg GPA is Cancelled
2) reg GPA is given to another person for the same property i purchase through reg sale deed.
3) reg Mortgage deed for 10lak with out possession.
how come its possible i am having the original parent documents, original reg GPA, reg sale deed and from previous owner(Principal) to my name i changed the patta also, now patta in my name and i am in possession of that property too.
all these entries in the year 2014 but my sale deed in 2011.
the person who convey the property to me through reg GPA for the sale of my specified property for consideration of 30lak and i paid the amount fully then through reg sale deed was executed to me 2011. Now his principal cancelled the GPA after 4years of completing the sale deed.
now the person who plan to buy from me is afraid of that entries and ask me to claar that, what i want to do now, whether i am legal owner or not, it is possible to do like this after completion of sale deed, help me.

E-stamping or franking

Hello Sir(s),

I am buying a property and getting the agreement done. The builder informed me that he will get the agreement done on the e-stamp paper. But at the same time, my colleagues and friends advised about Franking the agreement. I did some check on the net, but not clear information apart from that both are same.

Please help me to know, whether I need to get franking done separately also after getting the agreement done on e-stamp paper or its not required and the document is still valid legally even without franking.

Police verification for bank exam

MY SITUATION:
sir!i have been selected for ibps bank interview for clerical post.i have paid fine in the court once i went to pondicherry.myself and my friend was on the way to our room in car with 12 beers.nearly one kilometer before our room there was a checkpost ,the police man caught us for bringing beer.we said that our room was only one kilometer away sir,we are going there only! but he refused to hear that and wrote my details in paper in tamil.. I argued with the Police at the police check post who had stopped me and checked my car.
All this while they stopped one more car, the driver paid a bribe and was let off immediatelt. This was witnessed by my other friend. Then they sent me witha police officer and alcohol to the Police Office near by.
There the officer said the piece of paper was an offical complaint, a 'Special Report', from Check post police against me. They would have to write an official complaint, and I will be arrested. This is because 12 bottles of beer is a lot of quantity for the 4 of us. At the check post, the police officer said my car can be impounded. Here, he said I will be jailed and my friends can pay for the bail.

At this point in time I pleaded, not knowing what is the actual penalty and what was actually written in the 'Special Report', that I pay a penalty and they let me off. He asked me to pay 4000. He asked a friend of mine to sign for something called 'Sureity'. They said they will represent someone else for me in court and I don't have to come back. As soon i paid the amount they said, the case is over and I don't have to bother. I still don't know what was wrong, and what was the actual law and what were the penalties I really had to pay.
MY QUERIES:
1.WILL THIS BE CREATING AN ISSUE WHILE POLICE VERIFICATION?
2.SHOULD I MENTION THIS IN THE VERIFICATION FORM?
3.THIS TOOK PLACE IN PONDICHERRY,BUT I AM LIVING IN SALEM(TAMIL NADU),I HAVE NO POLICE COMPLAINTS ON MY NAME IN LOCAL POLICE STATION,SO IS THERE ANY CHANCE FOR ME TO HIDE THIS?
4.IN THE FORM THERE IS OPTIONS LIKE
A.HAVE YOU BEEN TO COURT?
B.HAVE YOU BEEN ARRESTED?
