Civil suite

Dear Sirs,

Be kind to tell me if no objections regarding registration under section 69 of Indian Partnership Act, Limitation Act & Jurisdiction have not been been raised by the defendant in the written. Can he raise at a later stage (say after 8 years).

Will this be admitted by Court of Law. If not, please send me reference of Supreme Court or any High Court Judgments.

Reference:

Book named "Law of Partnership" in Chapter VII Para 33., the following.

Plea based on Section 69. not raised in written statement : If the plea had not been raised in the written statement, it would not be allowed to be raised at a later stage in the proceedings.

Construction in own property

We own a house in a society in Gujarat since more than 5 years. WE have constructed a toilet (under construction) on back side of our house, its a duplex. Is it legal or illegal? What rules are applicable in either case?

Any site to check the last order for a civil case, without knowing the judgement date?

Hello Experts,

I'm trying to find the last order for a certain case which is listed as "CIVIL SUIT FOR DJ & ADJ 07 Of 2016" in the Saket court. The status on the official website- http://courtnic.nic.in/ddc_saket/content.asp is outdated since it shows the next hearing is on April 28,2016. I know the party name and the judge name but I'm not able to see the last order done in this case, since I don't the date of last hearing (since the status page is not up to date).

How can I find the last order? Please help

Declaration suit

We(plaintiff) filed permanent injunction suit in 2002. The permanent injunction was granted in our favour. In We(plaintiff) filed permanent injunction suit in 2002. The permanent injunction was granted in our favour. In first appeal by defendent the appeal was dismissed confirming the permanent injunction. The defendant filed second appeal and the suit is final argument stage.
Now defendant filed one more case in lower court for declaration.
Is it a valid suit ?
Is it bared by limitation act? Declaration suit should have been filed within 3 years from date of injunction suit filed by us.

Section 43 of indian contract act

Dear Experts,

A, B ,c and D were running a partnership firm. in 1999 C & D leave the firm and Made an agreement that the firm will give him 10 lakhs INR. and the partnership firm will continued by A & B. In the said agreement it was agreed that 2 lakhs out of 10 lakhs paid only when XYZ a debtor will pay to the firm. So 8 lakhs paid to C,D.

Now in 2003 the partnership firm dissoluted. A take over all business and become sole proprietor.

In 2014 A died. C and D were unawre about whether the XYZ has paid the debt or not, Till death of A.

In 2014 after death A, c & D filed a suit agauinst B only for the remaining amount. the legal representative of my client A is not joined.

Now C & D filed an application to join the legal representative of A in the suit.whether is tanable? The matter is reached to Plaintiff evidence.

Limitation of correction as per date of birth of birth certificate

R/sir,

My client date of birth is 12-12-1993 as per birth certificate and as per school certificate date of birth is 27-08-1995 and birth certificate is issued on dated 28-09-2015 please tell me if suit for declaration is valid and what is the limitation of made a correction in school certificate as per birth certificate

Full and final payment not received from the company.

I resigned from a software company few months back. They had not paid my full and final payment and also not given me my service experience letter. I took car lease from the company and for which I paid entire loan amount to the leasing company before resigning. There is nothing due on me. But the company's car lease department is saying that until I transfer car in my name, they will not pay my termination amount. NOC sent by them was expired as they delayed it and now leasing company is charging Rs. 2000 for duplicate NOC. I have tried to contact HR but HR does not respond. Can company claim this as a valid reason to stop my salary? Can I serve a legal notice to the company?

warrant issue

My husband is in Australia and not responding to divorce case here in india..court has issued warrant against him..does anyone know where this warrant should be sent..plss advise Australian indian embassy's address and email id if anyone knows..thanks a lot
