Unauthorised Encroachment

Hello sir, i am residing in rohini sec 1, where the houses are made on the basis of pocket system. In our pocket, one shopkeeper has encroached the road by stall of momos. My problem is that my car is parked in front of said shop in the night because of space problem in pockets to park our cars in front of our houses. In this condition, what should we do. Any legel remedy is available by law to stop encroachment.

Summary suit

two persons make fraud in business. On demand one person gave cheque of the due amount. The same are bounced. I lodged FIR against the both accused. I filed summary suit in the court and got decree. Defendant who gave cheques is absconder since long.
The second accused arrested by police. After trial when case became on final argument, accused offered the complainant to compromise. accused executed promissory note. Now he is not paying the amount. Can I file the summery suit against him.

illegal money lending

harpal kaur registered a case against my mom on 2011 a pronote was signed by my mom for 20000 rs at 3% interest pm i e ,36% pa now court also ordered us this interest rate while they hv no licence in 2015 she died within a month may be after one month of court order now girls of her put case on us in nov 2015 for recovery of same we didnt file any appeal against harpal kaur as she was died but after 3 month her girls registered case against us now we cant file appeal without lic and 36% interest is illegal in punjab can we hope for someone legal help its urgent pls reply where we should complain about themselves police or other place court order to pay 45000 interest now within 3 days

RERA Mumbai

Dear All
The redeveloper/builder have the commencement certifcate to start the redevelopment building project on which basses he is trying to sell his flat without registering with RERA. The consumer want to find out the fact of this site with Registrar but since not registered with RERA unable to trust the builder. Insuch case when.is the redeveloper/builder bound and must toregister With RERA
Does the redeveloper/builders comes under default and the penalty clause of RERA comes in force.

After buying land got notice

I buy a land recentlly and got notice that the land saller had contract with one more person in 2011 and now that person filed a suit. in that sale agreement time is not mentioned after 6 six he filed the suit.and the agreement is also not registered and written on 2 rs stamp paper. Now i contacted the lawyer and they are asking huge money.i had nothing to do with case but i dnt know what to do can anybody help me

Advocates rules

Hello,
My name is Pratik Shandilya from Mumbai and I am an Advocate at this moment. I am going to be a teacher and hence will surrender my SANAD (Lincense) to Mah & Goa Bar Council.

My query.
Can I legally write �Ex-Advocate� on my visiting card and newspaper advertisements?
I don�t find any impediment it doing it.
I will be into teaching of subjects like mathematics and completely detached from practise.
I believe, in writing �Ex- Advocate� as prefix before my name simple reveals my previous profession and it is allowed?

Please let me know panel experts. I will be also contacting Bar council in personal but still seeking advice here.

Pay protection in r/o central government employees on deput

Sir Iam working as postal assistant since 2011,june under pay of 30500(2400 gp) under level4 as per 7thcpc.Recently i heard a news in which deputation from other central govt department having 4200 gradepay {at delhi(my ambition to join Civil Service might be achieved @delhi with God's grace)} with identical payscale or with service of 5yr. Under grade pay 2400 under any cg dept.with service oriented field. Now i jus want to know abt the pros n cons to me to go on deputation or to go on Departmental examination tobe held every year, which gives a grade pay of 4600/_ as per 7cpc.
My advantages shall be specified in detail on going to deputation of 3years...
-Pay after retension to original parent department
-increments on deputation
-Positivity and negativity by utilizing this deputation

or
- to stay in this department.
Sir i would be ever grateful if any one helps me in clarification of my doubt in r/o revised pay rules and 7th pay commission and other factors in consideration.

Revision petition u/s115 cpc or article 227 in divorce

Sir,
In one of my personal case, the District Court dismissed the Divorce petition of my cousin.Subsequently, he gets acquitted from dowry case, he then filed the review petition and adduce the copy of the acquittal order. The review petition was also dismissed by the District Court
Since there is no appeal lies on the review order, he will now have to file the REVISION petition
1 Kindly suggest whether Revision Petition is maintainable under section 115 cpc or under Article 227 of the constitution?
2 Which is more preferable in a Divorce case ? Article 227 or section 115 CPC?

Agriculture land dispute

Ramesh was the owner of agriculture land. He entered into an agreement to sell the said land with Suresh sometimes in 1987 and the last date for sale deed was 1988. The vendee did not purchase the land even after 10-12 years. Later on Ramesh sold the said land to Mahesh in 2003. Before this sale deed could take place, Suresh had already filed a suit in civil court in 2002-03 with a forged receipt stating that entire money was given to the vendor but he is not transferring the land. The land had already been given to vendee for agriculture on a nominal fee per year. Vendee Suresh also filed suit for possession and suit for specific performance on the basis of that socalled forged receipt. In the WS, I have nowhere accepted that Suresh is in possession of the land but physically he is in possession since 1987. In the agreement, no part performance was shown and only earnest money was taken. His application for permanent injunction has been rejected by the lower and appellate court as well. Even my application has been rejected as no permanent injunction was prayed by me.

This land as of now is free from any kind of stay order. My name in revenue records existed upto 2011 but being influential person the vendee Suresh has been illegally successful in removing my name. The tenure holder is the original owner Ramesh. I have the valid sale deed without possession.

My submission - since the land is having no stay order now, and I have the legal documents of land, can I file a fresh suit for injunction against the vendee (plaintiff) Suresh who has forged document. If so under what rule or sections. Also how can I take possession. The suit is already 15 years old. A worthy lawyer has suggested that I should go for declaratory suit in the revenue court under new Land Revenue Code of UP.
