Stay on Decree

I own a house, that's loaned by ICICI Bank and the loan tenure ends after 2 yrs, I am regularly paying the EMI's. Meanwhile, in one of the co-operative bank's loan case, where I was a guarantor, the case has been ordered against us by district co-op court, and so the bank has initiated it's decree on my house, and the date of decree is also fixed.In fact there are 2 different properties mortagaged for this loan proposal with the bank, but bank has not initiated any decree procedure on these 2 mortgaged properties, and instead has kept my house for auction!
I have already informed ICICI Bank about this as they have the first right on my house, whereas this decree from the said co-op bank is not according to the law, as my house was never mortaged for the said loan, I was just a personal Guarantor for the loan case!
Pl. let me understand the procedure of law in these circumstances. Can the said co-op bank legally put my house on auction?? Can ICICI Bank (as joint owner of my house, till the end of loan tenure) stay this auction?? I have not yet recieved any reply from ICICI Bank on this, even after 2 weeks time of me informing them about this. What's the perfect legal way for me to obtain stay on the auction of my house?

Expecting advice in 2 days, as the auction is kept on 4th Jun.

written statement can be filed after 90 days , if there is law than kindly send me the citations,

Property matter

If one person having Ration Card, Electricity Bill in his name on one house, but his elder brother throug out him from his house. Now that house is locked. Give me advice how will he get possesion on that house.

Order for cost

In a dismissal order against review petition (trial court) states "Application for review of order dated 15.4.10 is dismissed being devoid of any merit with cost of Rs.2000/ to be deposited in DLSA".
Since no date has been stated in the order to deposit the cost, please advice:
a) if the cost has to be deposited within a certain time;
b) if I decide to file an application for Revision to HC do I have to still deposit the costs.

I do not have the Birth Place Certificate

Hello,
I am planning to apply for the Passport. The passport form's Entry Number 5 requires the attachment of the Birth Place Certificate.
While I have all other documents, I do not have the Birth Place Certificate.

Please advise.

A society dissolved - memebers devided

A cooperative society was farmed and purchased a land from the government. That land was divided in to plots and distributed to members of the society. But some piece of land which not useful to the members and not allotted to any member. After that such society was cancelled and disolved by the Registrar of Cooperative societies. Now "who will be the owner of the such vacant land. One of the perosn occupied such site and he sold that to my client and registed. Some other persons were argued that such site is not related to such occupied person, so my client has no right on that site. what options to have my client to success the above case. Can my client regularise such land from the Govt. on Market value payment basis. Please solve my problem with any judgeemnts.

partition suit & eviction process

i am one out of four sharers of my grand father's propety.atpresent a partition suit is going on & the same is not dispossed yet.but inspite of this one of the other co share holder has sold out the entire house without any consent of ours.and ote man who bought the house has served us with eviction summon.i dont to do?please give me a solution & tell me what is our standing.

I have a property in my passation since 1995-96 I was born on Feb. 1978. At present this property is recorded only on municipal record in the name of “X” who has died no any tax paid during these years by owners. My passation is continues but no any paper of this property (area 3000 sq fit).
1. What are the legal rights on this property I have?
2. What should I do for getting this property in my name?
3. Can any body has right to stop my adverse passation?
4. What are the procedure to get this property?

court fee in karnataka

Hello All,

1) What is court fee in karnataka for filing a family partition case. Evaluation of the property is 50Lakhs.

2) Can you file a partition case in one court even though part of the property falls in another jurisdiction? for ex: property A in jurisdiction A and property B in jurisdiction B. filing a case in court A for both the properties.
Does it require consent from all the parties involved? what happens if one party objects this arrangement?
