Affidavit Query.

Difference between affidavit and testimony. Because the defination of the testimony is as follows :

In the law, testimony is a form of evidence that is obtained from a witness who makes a solemn statement or declaration of fact. Testimony may be oral or written, and it is usually made by oath or affirmation under penalty of perjury. Unless a witness is testifying as an expert witness, testimony in the form of opinions or inferences is generally limited to those opinions or inferences that are rationally based on the perceptions of the witness and are helpful to a clear understanding of the witness' testimony.

So I think there is no difference between affidavit & testimony. Pls correct me if i am wrong.

What is difference between "UNDERTAKING" and "AFFIDAVIT". Please also apprise the legal provisions thereof.

In UP and Uttarakhand on every paper which is filed in a civil suit, one rectangle is made having court's name, parties name and case No. I want to know what is it's releveancy in which law it is provided. Some moths ago I heard that now it is not compulsory to be made, if it is true please provide me the relevant information.

Specific performance

A entered into agreement of sale of agriculture land and had paid some advance to B and balance willing to pay with in two months after two months B unwilling to come forward for registration what is time to issue a notice and after that what is the time to file suit in the court

Temporary Injunction

R/Experts,
I have filed civil suit claiming injunction and possession by removing encroachment of defendant over the suit land.Defendant encroached plaintiff's as well as Government's land and constructed hotel on it.Now he demolishing his hotels old construction.Plaintiff restrained him by filing suit,civil court granted status-quo.Now matter is for hearing on T.I. petition.Defendant took stand that he never encroached upon plaintiff's land so why plaintiff raising question when land is of Government?Defendant taking stand that plaintiff has no right to restrain defendant upon the Government land.
Can anybody tell me whether neighbour has right to restrain encroacher though that land is of Government?If yes,please give me some rulings of Hon'ble Apex Court.
