(xii) Any person who is an office-bearer or an employee of an educational, scientific, social, cultural or other institution, in whatever manner established, receiving or having received any financial assistance from the Central Government or any State Government or local or other public authority.
My Query is as follows:
As per the above clause interpretation if the school or college getting any financial assistance "It means any subsidy" & if the office-bearer or an employee takes any bribe or gratification (which is one & the same) while performing the duities given to them than is HE OR SHE is punsiable under the prevention of corruption act, 1988.
any case case if any & pls correct me if i am wrong.
I also think that financial assistance can also be in kind.
Also exaplin me the meaning of the above mentioned as the definition is not give under the act.
1 office-bearer.
2 financial assistance.
Pls help me. to understand that whether i am right or wrong.

As per the Prevention of corruption act, 1988. Section 2(v)says as follws.
(v) Any person authorised by a court of justice to perform any duty, in connection with, including a liquidator, receiver or commissioner appointed by such court.
So in the abovementioned the statement says "Any person authorised by a court of justice to perform any duty" it means that if the a person appointed as a guardian to look after the childern when they are minor & if the appointed guardian takes any gratifiaction or bribe (which is one & the same) than he is punsibleable as per the prevention of corruption act, 1988 as the above mentioned clause interpretation looks like that he or she (guardian) is punsiable.
Pls tell me if i am wrong or right or if any case laws.

once the case is dismissed in national commission, are there any provisions in consumer act for its revision appeal for revoking the dismissal and permit for case admittance.if so,please mention the rule/section for the same.

Sir,
My father is about 75 yrs old and due to his physical constraint he is unable to attend the court for any purposes. I am living with him and do all the work on behalf of him. We r three brothers. Two lives outside. Can I replace my father for court work like putting signature and deposing on behalf of him in the court? My father as well as other brothers too r having no objection. For this what I will have to do? Authorization letter or power of attorney is needed?

Sir,
I have purchased a land thro'registered sale deed. In this area mentioned is smaller than the actual due to the mistake commited in measuring the plot. Although intention of the seller is clearly expressed in the deed that I am selling entire land of this plot and nothing remained or neither me nor any of my heirs have nothing left and having no concern in this plot. Boundary mentioned is correct. The heir of the seller(is dead) is not ready to sign the rectification deed. So, how can I get it rectified thro' court?

Sir,
I got a Central Information Commission's (CIC)decision, denying certain information, against which i am planning to move delhi high court.I have been denied certain information under the RTI Act,2005.
It is to submit that there are some favourable Delhi High Court's decisions in our favour in the instant case.
As per the RTI Act, there is no appeal against the CIC decision and hence a writ petition has to be moved.
It is also requested to advise whether the said writ petition can be moved in my place i.e. AP High Court or the Delhi High Court has the exclusive jurisdiction in such matters.
Kindly suggest a good advocate for the above purpose?

Hi,
I am having my flat's agreement in the name of myself with my father as joint owner. my name comes first in the agreement.
now bcause of some family dispute i want to have all the rights relating to flat with me only.

Credit Card Related
Credit card due is 7 years old. Since 2003 there is no transaction and it has been blocked. (Outstanding amount 25000/- original).
In the begining the recovery agents started harrassing and the card holder filed a criminal complaint case against the recovery agency. Then they stopped visiting home and committing nuisance.
Now since last month they again started sending recovery agents and causing huge harrashment.
If I am not wrong the debt is time barred and bank can not file civil suit to recover the money.(please correct me if this view is wrong)
The question is,
If the card holder now file a consumer case against the bank for mental agony and praying for compensation, whether bank can ask the money in w/v as a counter claim?
Whether court can orer to pay the due first?
Senior's opinion needed..
