Whether the order of the High Court can be challenged by the way of SLP before Supreme Court

Dear Sir,
My OA application has been allowed at CAT and Op has filed the writ Petition before the High Court which has referred back the matter to the CAT for reconsideration of the plea raised by the OP in its writ petition and now my Application will relisted before the CAT in the month of Nov 2010

My queries are since the Application will be relisted via the order of the High Court, Can I file the Special Leave Application against the order of the High Court before the Supreme Court which has listed my Application again before the CAT as the OP is not allowed to reagigitate the same pleas which he has already arisen?

Should I to face any legal complications?

Respected Experts,

“A” (actual owner of a landed property) has executed a Registered Agreement of Sale cum General Power of Attorney (with possession) with “B”. Now “C” wants to purchase the lands from “B” basing on the said document and “B” is ready to execute a sale deed in his favour.

Now “C” came to know that there are some misunderstandings in between “A” and “B” and thus “A” openly disclosing that he is going to cancel the said Agreement of Sale cum GPA at any point of time.

At this situation, if I want to go to purchase the said lands from “B” on the strength of the Registered Agreement of Sale cum GPA, should I have to face any legal complications, in future or not? If so what it would be and what will be the remedy.

Plz. suggest me suitably.

Does the entry in the revenue record ipso facto enough for an individual to claim ownership of an immoveable property.

Arbitration and Conciliation Act, 1996

Dear All,

If the parties to a contract agree for appointment of a sole arbitrator mutually agreed upon and in the eventuality of a dispute if either of the party has invoked and suggested name of its Arbitrator upon which the other party has reverted back by putting forth the name of its Arbitrator.

My question is that by conduct can the parties to a contract (if in case they so mutually agree) can by pass the term of this contract and resort to themselves appointing one arbitrator each who in turn may appoint an umpire/

Is it legaly tenable or they have to approach the court for this purpose.

Thanking you in advance

Best Regards

Whether I am entitle to file Application in the Supreme Court

Dear Experts,
My Application in the CAT has been allowed for regularisation of services by an order given in Feb 2010 but the OP refused to comply the order as result I filed the contempt petition which has given 10 days notice to comply the same
The OP filed the Writ Petition before the High Court on the ground of delay and latches which was also been raised before the CAT .The High Court refer the matter to CAT for reconsideration of the plea
The CAT has dismissed my C.P on the submission made by the OP that the order has been overturned

My queries are:
1 whether I can move my Application before the Supreme Court of India under SLP as the OP has reagigtated the matter before the High Court?
2 and has challenged the order directly before the High Court

Whether Contempt Petition reamins stands/or dismissed if the High Court ref for reconsideration

Dear experts,

I have filed the contempt Petition(C.P) in the CAT for non implementation of the order. The O.P filed the writ petition against the quashing of order. The High Court didn't quashed but refer it to CAT for consideration of certain point raised by the O.P

Today the OP counsel has made the submission that the High Court has overturned the order (but the real fact was that it was just referred back to the CAT) After hearing the contention from the counsel of the OP the CAT has dismissed my C.P
My queries are:
1 Whether the C.P can be dismissed if the High Court has only send for reconsideration?
2 Since the Order of the High court have not been received either by me or by counsel of the OP .Can I revive the C.P by highlighting the fact that it was not overtuned but only referred for review?

3High court has neither admit the Petition nor granted for stay whether the OP is entitled for such relief?
