NEED CITATIONS URGENTLY ON FOLLOWING SUBJECTS

Dear friends, I am Silabhadra Sastry, Advocate, Bhubaneswar,
I need some citations (if recent case laws are given I will be highly obliged)
On following subjects, pl help me if you can, I need it by tomorrow morning.

1. Once land acquired by Govt. under land acquisition, compensation paid to that effect, the same land can not be taken by the land owner.

2. Compensation amount in a land acquisition case is to be deposited in court as per section 31(2) L.A Act in case of disputed title of the land of land owner.

3. Onus lies on the plaintiff to prove his case to ascertain the possession and area map by help of Survey knowing commissioner or other expert like pleader commissioner etc..

4. Note of possession in name of a person in the final settlement Record Of Right never creates any title

Expired learning licence can be submitted or not

Ref my query on 15/11.thanks to you all for
your valuable advices.Now pl. guide me whether
expired learning licence can be submitted to the insurance company alongwith RC books or
not as it is now asked by the insurance co.
though there was no injury to anyone other
than pillion rider.

there is a tripartite agreement between the builder, buyer and the bank and the builder agrees to pay interest for an interim period till possession of house is given. but the house is not constructed only. can the buyer of the house ask for injunction against the court to not demand the interest from him or ask the builder to pay the interest since the object of the contract has been frustrated?
is there any case law with similar facts? PLEASE HELP

Can one check all the civil cases which are in process in Teez Hazari Courts by the "NAME" of the case or by any other method by checking the computers installed in the court.

Can one check the case in process through internet or is there any other method to check that .

Sanitary problem

Sirs,

Septic tank(storage for human excreta)of department apartments, lying near the gate of my alloted land/building has been leaking for several days. I verbally requested PWD(public wrk department) for either emptying or relocation of the said tank, but the PWD authority didn't care by simply citing the lack of maintenance fund.
What should I do? Pls. advise in details.

Witnesses for the Will...

If one is deciding to have a witnesses to his parents what will you think of the following choices ...

1. LEGAL HEIRS who you apprehend to create problems later on during the execution of the will-- Do having them as witnesses would be easy for the execution of the will or could they create problems later by stating that the executor of the will was not mentally sound or might allege that the will was made under undue pressure or coercion ...

2. YOUNGER PERSON - as an older person has higher chance to die at the time of the execution of the will . So the question is that if the person who is a witness to the will should be alive or does it not matter at all...

Public Trust in Mumbai

Public Trust covered under Bombay Public Trust Act 1950.
Trust Rule requires that 4 Trustees be elected by direct elections by the members.Maximum term is for 3 years or till pne resigns or paases away.
3 trustees have reisgned but instead of having elections the fourth Trustee has co-opted members who do not have the trust or the confidence of a majority of the members.
Accounts presented for 2008/9 too are filled with errors so members have refused to approve them without full details being provided.
Trustee now says that even though his term is over he will not call for elections till 2008/9 and 2009/10 accounts are passed as presented by the Auditor without questions.
What does one do legally now.

Signatories to a Public Trust Bank Account

A Public Trust approved Rule states that the signature of the Hon Treasurer is compulsory and that of the Hon Secretary is the scond signatory to all Trust cheques.
But the President got himself and one more Trustee as alternative signatories.
We are told that bypassing both the Treasurer & the Seceatary the President and the other Trustee have been issuing cheques, enashing cheques in bearer form
(cash across the counter).
We spoke to a bank official who has said that the bank is only concerned with the operating mandate filed and not the Trust rules.

What do the members do when they know (but cannot get proof) of this siphoning out of funds.
Trust banks with a co-operative bank and they say they not covered by the RTI Act in Maharashtra.
