conditional will

my grand father execute a will in favor of my father and my uncle, who is brother of my father only to enjoy the property, where my grand father allotted A-share to my father and B-share to my uncle, but he recited in the same will and he give right to his grand sons, who born through my father and my uncle to alienate, mortgage the property

in this situation, my uncle had only daughters, now he intend to sale the property to meet out the marriage expenses of his daughters.

Hence kindly provide idea or any judgements regards this

Void marriage related query

Mr. "ABC" is married with a daughter. His wife Mrs. "XYZ" was put under severe torture and physical harrassment and as a result her family got their daughter ("XYZ") out of their family and she never returned for anything not even her daughter. Though the seperation was not legal as the divorce was never done.

This Mr. "ABC" who is a notorious fellow made fool of a young girl "DEF" by acting as a caring father of his young daughter whose mother left him. And he married the young girl by eloping with her without the permission of the girl "DEF"'s parents and family.
Of late Mr. ABC has been harassing the girl's family by talking abusive language on phone and shouting and creating scene near the girl "DEF"'s home whenever they go there.

Girl DEF's father wants that his girl is out of the hands of this notorious person and also that he stops his non-sense against anyone from his family. Please advice what steps should be taken by him and what are the kind laws will help him in that?

Divorce Case before Civil Judge [S.D] ?

My Learned Friends,

I had seen that in Punjab the divorce case is filed before District Judge but here In my City "Muzaffarnagar under Uttar Pardesh" Divorce Case is filed before Civil judge [ Senior Division] because local lawyer of my city told me.

My Queries are:-

1. It is right to file a case before Civil Judge [S.D] as the Def. of "District Court" is mentioned in Sec 3(b) of Hindu Marriage Act.

2. In your state where you file the divorce case that is before District Judge Or Civil Judge [S.D] ?

status of counter claim

my case is pending in delhi high court, inspite of filing written statement, my counsel filed counterclaim which has been registered and later on filed WS with delay of 110 days which will be argued in next month after notice to plaintiff. what will be the status of my case if WS is not accepted. whether can I take defence of my counter claim. can counter claim may be treated as my WS?

Power of Attorney without consideration...

A General Power of Attorney is to be made (without consideration) in Delhi which gives powers to his son to sell his properties.

Will this POA needed to be registered or not.

If yes what will be the stamp duty paid.

Do the details of the property been given in the POA or a general clause to sell all his properties is enough.

my query is can land which is already converted to non agricultural and now is in same status ,can such land be acquired by maharashtra industrial development corp ,in maharashtra?

who is the landlord/ owner of property??

Dear all,
Plz suggest me to come out the situation:
Mrs. ''M" widow was title holder and owner of a property consisting 20 shops. She has a Son 'S' only as legal heir. She executed a will in favor of her daughter in law 'D' and bequeathed all her property to said 'D' due to mis behaviour of her son. After her death the son 'S' filed some suits against the tenants of shops for eviction. The real will holder D wan't made party in that suits. Despite of fact that S has no right on the shops the suits r going on the procedure. The tenants not raised the objections abt the ownership of plaintiff son because they have not knowledge of that Will.
Now, the S and D has been separated. afterwards, S filled application under O.1 R.10 of CPC to subs. or add as party in suits along with copy of registered will. But the Court have rejected the same with giving the reason that in tenancy matters title couldn't be decided. In appeal she again suffered reluctance. High court denied to entertain the writ pet. against both orders as well.
After this, D sold property to Someone B.
B is my client, What should I suggest him to do?

Any procedure from escaping atrocities from sister-in-law

Sir,
I am the counsel not well versed with criminal law practice

My sister-inlaw left the matrimonial home without reasonable cause and served a legal notice to my brother and her in laws for false case of dowry harssment

I filed the anticipatory bail application before the ASJ which was found to be infructous as no FIR was lodged in the name

and then I filed the HMA case under section 9 for RCR which was disposed off as she has given consent for willing to join him

I live in joint family with my parents who are old but she used to harass me and my parents over trifling issues and used to provoke us by physical and verbal abuses

I need the good advice in order to crub such menaces at home. If her harassment used to continue what are the remedies left so that I can file appropriate applications before appropriate court

when the partners has brought undivided share of land in their individual names as capital in partnership firm. is this constituted as transfer of land and stamp duty is payable on this...

Dear Experts

weather a minor can clam partition in the property inherited to his father through his grandfather,died in the year 1996 and the minor born in the year 1993. The father of minor has 2 brothers, 1 sister and mother alive and they have prepared a mutual partition and got it registered in the year 2000.
