FREEZING ACCOUNT

SIR,our civil judge is asking under which act i can seal a bank account?judge is saying i dont have authority to seal the account if it is there then bring to me in written.REPLY REQUIRED URGENTLY.PLZ HELP

Harassment by neighbor & false report

Dear experts

I am a resident of DDA Flats in Dwarka. We are south Indians who are residing in the DDA Flat for last six years.

One of our neighbor adjoining our flat last year is creating a havoc for us. He has dispute with us rearding Car parking, as he would not let us park the same. He want to gormandise the entire space for himslef.

Now last weak only he falsely filed a complaint in DDA/MCD & RWA alleging the durability of house statting that our house has developed a crack & pose threat in general. The compliant is supposed to contain the name & signature of other neighbors which on our investigation was found to be false. We have got the signatures from our neighbors stating that complaint is false & is based on forges signatures.

Please suggest a couse of action as we feel we have no other alternative but to action against the said miscreant.

Regarding My Father WILL

My Father has written a Will before the his Death.

He mention that if my mother expired before his death the whole property should come to me .

Else

If my mother is still alive then She Shall be entitled to enjoy as a sole beneficiary and Universal legacy of this will till her death.

My syster took my mother and kept in her house.
I went to court and brought injection : Not to elinate property.

My mother had written another will stating that after her death the whole property should go to my syster.


So far i my father not given even 1 paisa to me .


Will i get Property by any chance ?

right of daughter

my father-in-law had a land,which he got from his father.my f-in-law sold that piece of agriculture land about 10 yrs back without any concent of my wife (his daughter)...we came to know about just 3-4 months back.now if my wife wants to become a farmer..can she..?,or can she ask for any money from her father which he got from selling the land...secondly, if my wife cann't or don't want to ask for her right to her father or to her brother can my daughter ask for...? or what is my daughter"s right in her maternal forfather's property. plz advice.

ARE THERE ANY JUDGMENTS GIVEN IN FAVOUR OF ONE WHO MADE AN UNAUTHORIZED CONSTRUCTION IN THE COMMON AREA OF APARTMENT EVEN AFTER THE CORPORATION HAS REJECTED THEIR APPLICATION FOR REGULARIZASTION

divison of agriculturer land

ram prassad died in 1963,her wife died in 2008,ram prassad had 10 acre land, haw would be it divided among one son and one daughter,plz mention some rulings too, would be the division equal or something else. its being a matter of "svatav" of daughter.

Defamation or Contempt Case ?

A witness standing in the witness box & giving the evidence or he was cross examined during that time other witness standing by side or any person for the or public sitting in a open court (called as a layman audience) says some bad words to the accused or the witness who was cross examined than it has been said as per the contempt of cour act, 1971 section 2 he was purposelly interfering the court proceedings so it is said that it is a contempt of court & person is laible for contempt case but as per section 10 no High Court shall take cognizance of a contempt alleged to have been committed in respect of a court subordinate to it where such contempt is an offence punishable under the Indian Penal Code (45 of 1860).
if any offence is punisable under the IPC, 1860 than no contempt case will be held. So know contempt case should be filed or section 499 (defamamtion) case should be filed against that person. Becasue as th person was givin bad words to xyz person in the court during the proceedings so it is a defamation becasue he was insulting the person without any reason but simaltenoulsy it is contempt of court also so which one will prewill & can both the case (contempt case, Section 499) can be filed on that person ?


Section 10 Every High Court shall have and exercise the same jurisdiction, powers and authority, in accordance with the same procedure and practice, in respect of contempt's of courts subordinate to it and it has and exercise in respect of contempt's of itself.


Provided that no High Court shall take cognizance of a contempt alleged to have been committed in respect of a court subordinate to it where such contempt is an offence punishable under the Indian Penal Code (45 of 1860).

LEAVE TRAVAL CONCESSION

SIR,
I AM AN ASI(MINISTERIAL) IN CRPF SINCE 2001.
CCS (LTC) RULE IS RUNNING IN MY DEPTT WHICH IS USUALLY USED BY OTHER CENTRAL GOVT DEPTT.
I HAVE BEEN SANCTIONED 4 YEAR LTC FOR 2006-09(EXTENTION 2010) DURING 2010 DECEMBER. BUT MY COMMANDANT HAS BEEN CANCELLED MY LEAVE WITHOUT ANY REASON SO I COULD NOT AVAILED LTC FOR MY WIFE, FATHER AND MOTHER.

I REQUEST YOU TO CLARIFY THAT IS ANY RULE SO THAT I COULD CLAIM FOR LTC COMPENSAITON WORTH RS. 14,000/-

THERE IS NO RULE OF AVAILING LTC AFTER 2010 (FOR 2006-09 PERIOD)

Distorted and misrepresentation of 'facts in issue'

There is an instance of Distorted and misrepresentation of 'facts in issue' by plaintiff.



If defendent explicitly raises plea of 'affirmative defense' that facts re misrepresented. also moves court for strike off the pleadings as well as dismissal of petition


I am confused that:
Can it be called as 'affirmative defense' in the first place?



My understianding is that only apologetic/incidental excuses and justification is called 'affirmative defense' where there is no mens rea.



Also, should/could the defendent get some damages or compensation? Is there any pecuniary limit on compensation?

Validity of conditional will


"A" have certain landed properties by partition deed (Ancestral property)and he bequeathed his share (which is allotted by oral partition) to W, D with absolute right after his demise and he also imposed a condition if they desire to sell the property they must dicuss with "X" and follow his advice.

1. If "W" and "D" sell the property without discuss with "X" what is the validity of the said SALE.
