The Administrative Tribunals Act, 1985
SECTION 1 SHORT TITLE, EXTENT AND COMMENCEMENT
(1) This Act may be called the Administrative Tribunals Act, 1985.
(2) It extends, - (a) in so far as it relates to the Central Administrative Tribunal, to the whole of India;
(b) in so far as it relates to the Administrative Tribunals for States, to the whole of India, except the State of Jammu and Kashmir.
Query : How to know whether any tribunal is a Central Administrative Tribunal or States Administrative Tribunals becasue if come to know that it is a States Administrative Tribunals or Central Administrative Tribunal than we can apply this act ?
Also for the income tax purpose there is special act known as (ITAT) income tax appellate tribunal so that act is applicable & can we say that The Administrative Tribunals Act, 1985 is also applicable if there is a overriding section than which will prevail first.
Can anybody said me the case law which says that if there is a special tribunal than The Administrative Tribunals Act, 1985 is not applicable PLS.

Dear Sir,
What is the procedure for production of email in court and marking of the same as an exbhibit. Whether we have to follow Section 65B of evidence act? Is there any ruling on this aspect?

Indian Penal Code, 1860 Section 54
1) Section 54. Commutation of sentence of death.-- In every case in which sentence of death shall have been passed, 3[ the appropriate Government] may, without the consent of the offender, commute the punishment for any other punishment provided by this Code.
Query : so can we say after reading the the abovementioned section lines which says
(may, without the consent of the offender, commute the punishment for any other punishment provided by this Code.)
the court can so without the consent of the offender charge also punishment other than mentioned punishment mentioned u/s. 54 Pls clarify it in detail. ?
57. Fractions of terms of punishment.-- In calculating fractions of terms of punishment, 4[ imprinsonment] for life shall be reckoned as equivalent to 4[ imprisonment] for twenty years.
55. Commutation of sentence of imprisonment for life.-- In every case in which sentence of 4[ imprisonment] for life shall have been passed, 5[ the appropriate Government] may, without the consent of the offender, commute the punishment for imprisonment of either description for a term not exceeding fourteen years.
Query : I understood the meaning of section section 55 but confused on section 57 as what does it means is it relevant with section 55 or not which will prevail whether 14 years or 20 years pls clarify me in detail confused whar does the section 57 wants to convey ?

MR.F is a missing person from 1998.while he has wife,mother and brothers.he is muslim.by 2007 his wife got divorce and remarried another muslim person.now who are his heirs by muslin law?Will his wife(now divorced7remarried) get share in his property?can his brothers&mother sell his property as heirs?

i cheated MR.A by a false document which registered in register office for a property deal in a special circumstance.now me and MR.A in a compromise.i paid him compensation instead of loss by me.now he agreed to cancel said document.can i quash this document by his consent?will i face any criminal case from registeration dept.or police?

Few months back i tried to book cinema tickets for City gold cinema on net. After entering payment details of credit card i was directed to their booking agency viz. Ticketduniya. Several times the payment was debited from my credit card but transections were unsuccessful. Upon inquiring with this ticketduniya after finding their tel no. with great difficulty i was told that since tickets are not booked money will be refunded back to you. Now i have received bill from Barclays bank credit card for above failed transactions bearing a date 45 days later. Upon calling bank i am told that i will have to make payment otherwise penalty and interest will be charged and my credit rating will be in black. Is there any authority that monitors this credit card agency that i can approach so that i do not have to make payment till this dispute is resolved? How can i take legal action against City gold cinema for falsely lodging claim to credit card agency even though they had not booked tickets? Even to do investigation Barclays bank is asking Rs. 100 per each failed transactions just to lodge disputed transaction claim. Which competent authority i can approach with my grievances?Can i file some claim for damages for inconvenience that would be caused to me ?

ACCORDING TO HER WILL(THE WILL IS ALSO CHALLENGED BY US)
THE DISTRICT COURT HAD APPOINTED MY ANOTHER UNCLE(2) AS A GUARDIAN OF LUNATIC UNCLE,
AND PASS THE ORDER NOT TO SELL THE PROPERTY WITHOUT THE PERMISSION OF THE COURT,

I WANT TO KNOW WHETHER THIS IS AN CRIMINAL OFFENSE OR JUST A CIVIL MATTER?
POLICE REFUSES TO SUBMIT CRIMINAL REPORT AS IT IS JUST AN CIVIL MATTER.

i hold a joint property(land) with A. now A has erected boundary without intimating me.his intention seems to be malafide.can i make a an application for injunction to prevent him from misusing or usurping the land?is it necessary to file a suit before making an application for injunction orders?
