Noise from small scale industrial unit

Hi,

Adjacent to our society, there are two small scale units due to which there is unbearable noise in our building(morning 8:00 a.m. to evening 7:00 p.m everyday including weekends) and in my flat.
Is there any law related to noise levels adjacent to residential buildings by which we can complain against these units.

Tribunal.

The Administrative Tribunals Act, 1985




SECTION 1 SHORT TITLE, EXTENT AND COMMENCEMENT



(1) This Act may be called the Administrative Tribunals Act, 1985.




(2) It extends, - (a) in so far as it relates to the Central Administrative Tribunal, to the whole of India;



(b) in so far as it relates to the Administrative Tribunals for States, to the whole of India, except the State of Jammu and Kashmir.

Query : How to know whether any tribunal is a Central Administrative Tribunal or States Administrative Tribunals becasue if come to know that it is a States Administrative Tribunals or Central Administrative Tribunal than we can apply this act ?

Also for the income tax purpose there is special act known as (ITAT) income tax appellate tribunal so that act is applicable & can we say that The Administrative Tribunals Act, 1985 is also applicable if there is a overriding section than which will prevail first.

Can anybody said me the case law which says that if there is a special tribunal than The Administrative Tribunals Act, 1985 is not applicable PLS.

Query : What does it means "With its grammatical variations and cognate expressions." in any law where his words occurs.

Eviction

Respected Esperts,

The District Magistrate served me a eviction notice as I have occupied a government land for residential purposed without prior order from govt.

Now what are the legal remedies available to me from such notice.????

For stay of this order should I approach to High Court or concern District Magistrate.???

Any other suggestion.???

sale of porperty

Respected experts,

If I have apprehension that my agriculture land may be sale by caretaker of that agriculture land in my absence.

What are the legal option that available to me to cheek such illegal sale.???

Should I published a public notice in local newspaper and argued people to avoid such illegal sale deed.???If Yes pliz en-light me under which provision of law this is allowed.??

Partnership Deed

Clause in Registered Partnership Deed stated
"Death shall not dissolve the firm Ipso-facto. Instead the legal representatives of the deceased shall stp in as partner(s) on the basis of this deed,the clauses of which shall Mutatis-Mutandis be applicable and the firm shall continue till such time as alternative arrangements are finalised"

Without Probate or Letter of administration from a Court, can the remaining partners usurp the assets of the deceased and divide it among themselves, leaving out the other children of the deceased who have a claim on the Estate of the deceased partner.

Not only have they divided it among themselves, they have gone and dissolved the very profitable firm among themselves.

What is the legal implications of such actions by the partners

gift of property during his life time

my late maternal grand father during his life time(while on death bed) has gifted almost his entire property to his only son leaving his 4 daughters penniless. i've heard tht in mohommadan law the father can gift his property to anyone including his hiers in any proportion during his life without being questioned. do we have a ground to file a case if so is true??

Removal of Employee

In a Pvt. Company an employee is removed without giving any Notice only by saying that he had misconducted and the same stipulation is given in terms and condition of appointment letter that in case of misconduct an employee is removed in case of misconduct without giving any notice.Can a Company can do so without imitating Rule of Natural Justice so as we know that at the time of employment oftenly employee has to follow all the terms & condition for the sake of employment.

My second question is whether appointment letter is contract between company and employee and if it is than which sort of?

Info on Civil Suit Required

In a Civil Suit based on Specific Relief Act involving Plaintiff (private party) and two Defendants both Government Departments.

In the above suit D1 was set exparte as they failed to file Written Statement. D2 filed Written Statement following which Plaintiff filed Rejoinder.

Now D2 is not filing Counter for the said Rejoinder (more than 150 Days) what are the next stages in the Civil Suit ?
