Imposition of levy


Can a royalty (or any tax or fee) be imposed, for the first time, without the authority of law or a notification not having the force of law (i.e. through a mere executive decision)? If not, continued payment of the levy for more than three decades would be held out as an estoppel or limitation for seeking relief from the Court?

Order 39 Rules 1 and 2 read with Section 151 CPC

Sir, Please advice legal repurcussion on the following:

The shop is ancestral property and till date deed of partition is not done. The owner and the tenant made an unregistered agreement. The owner died before the expiry of agreement date. The tenant did not agreed to the extension of agreement. The tenant filed a civil suit in the lower court against the legal heirs of a shop under Order 39 R 1 and 2 r/w Sec 151 CPC. The legal heirs are wife, unmarried daughter and married son. The wife and daughter are not working. The son is working in a shop and he has two daughters. What legal help can be advised to the legal heirs to vacate the tenant frm the shop. The son is interested to start business if the tenant vacate the shop. The tenant is financially sound and has handful of property and business.

I am respondent in an appeal. I found a suitable judgement in my case and this judgement though pulshied in HRR is in some other headnote. Althout the judgement is fully applicabe in my case. What should i do can i take out a internet copy from haryana high court website and place on file or should i get a certified copy of the judgement.

Non execution of the Terms of Sale Deed and Undertaking givne before Police

Seller showed me an Agricultural plot and its Title Deed(7/12). In good faith the Sale Deed was made and due payments made. The seller was asked to proved that the shown plot actually pertains to the Title Deed given. Private Land Survey was made and it was found that the Plot belonged to adjacent farmer and mine in that farmer's compound along with his own land. The farmer says I had not put a fence to my plot and that he has been enjoying that plot for over 12 years and cannot give me. Police complaint was lodged and the seller gave an undertaking on stamp Paper that he would give that land along with approach road to nearby public road. He has not given peaceful possession of the said plot for over last 2 years and not fulfilled the commitments as per the Undertaking given at Police Station, to me, against my complaint. Under what all charges he can be sued in a Civil/Criminal Court after sending him a legal notice

when a company has an arbitration clause,can a customer file a suit in an appropriate court if he is not satisfied with the decision of the arbitrator?

sister want their share

dear sir,

we are a family of four brothers and three sister.

my father expired in the yr 1983, the probate of the will was obtained in 1986, and in the year 1999 the house where we currently live was transferred from my fathers huf to his four sons and my mother, this was done because in the will my father had written that his daughters dont have CLAIM INTREST AND SHARE in his estates in the property(also he had mentioned in the will that he would like to give his 1/6th share in the property to four of his sons). also we had orally partitioned in the year 1999 (we have no papers supporting the same) our house and place where each member would stay though there are no walls supporting the same

now my sisters are threatening to claim their right in the said property because of the amendment in the year 2005, can they do it ?

kindly help as we dont not want them to claim their right

pecuniary jurisdiction.

i am form maharashtra studying law 6 months ago there is a question in mind that what is the pecuniary jurisdiction of the bombay high court in any matter also related with original, appellate jurisdiction ? small causes court pecuniary jurisdiction ? bombay city civil court pecuniary jurisdiction ? & how to known that pecuniary jurisdiction is changed or not ? Pls help me out to solve the problem either form any book or any side or post the answer here pls because any of the act has not define the pecuniary jurisdiction ?
