We have a shop on Pagdi system in a chawl, due to increase in the height of the road; the roof of the shop has come down close to 6 feet from the ground. We have no option but to increase the height of the roof to 12 feet from the ground, but all the contractors I have contacted say that we will have to spend close to rupees 1 lakh in bribing the BMC, police, and the complainers. Please suggest because I am shocked to hear this lawlessness. Can’t I go ahead without bribing?
A civil suit was filed in the lower court over a property dispute. The respondent objected to the suit and sought dismissal of the suit quoting the previous suits filed by the predecessors of the petitioners and the order issued by the lower court in his favour in the previous suit. But, in the current suit, the court observed that while the previous suits claimed ownership of the property, the current suit sought the legal rights on the property and refused to dismiss the dismissal plea by the respondent. The respondent immediately filed a CRP in the High Court of Madras and the case is dragging for more than 2 years. The respondents sold the property to several persons splitting it into plots and the petitioners want their rights to restored on the property despite.
The dispute is that a piece of land which was declared to be used as common burial ground of the dead family members was sold by the foster son of the widow of the original owner who was childless. While it had been agreed upon during partition that the property should be exclusively used for burying the dead family members and the partition deed duly registered in the Sub-Registrar’s office, ignoring the condition stipulated in the partition deed and selling the burial ground as residential plots should be made as null and void and the status quo should be maintained is our contention. Having acquired the property as the foster son through the will of the widow of the original owner, I am the owner and I can do whatever I want is the contention of the respondent. He already obtained an approval from the local DTCP for residential layout by suppressing the actual facts and converted the burial land into residential plots and sold the same to several people numbering than 40 people.
Now, the question is, can I seek interim orders from the High Court Chennai, to continue the burial as our rights are denied when the original suit filed in thelower court is held up due to the CRP pending in the High Court ?
If yes, can you please quote me the rule or authority under which I can approach the High Court ?

after reading the attach doc can come to a conclusion that the circular is binding on all the department whether it may be (civil, criminal, tax or ANY ANY ANY ANY Deparmtent) also to ANY ANY Court. is there any law which says about the cirular.

We are four brothers and 4 sisters.
3 of my sisters are married before the year 1980 and the fourth sister got married in the year 2000.
My grandfather has two self acquired properties in his name - One of them is a vacant land and the other is a residential buiding.
My Grandfather died in the year 1980 leaving behind an unregistered ' WILL ' which says that both of his properties should be inherited to his male grandsons only.
The ' WILL ' has two witnesses. One of them is my maternal uncle & the other person is a friend of my father as witnesses.
All of my sisters have executed an unregistered agreement in favour of our brothers on stamp papers taking demand drafts as " PasupuKumkumalu " for the sake of relinquishing their rights on the said vacant land in my grandfather name.
My grandfather has purchased and gifted some other vacant land in my mother's name for taking care of him in his old age.My mother has already sold her piece of land long ago during her life time
Note:
My father died in the year 1984
My grandmother died long ago before my grandfather died in 1980.
My question : Do my sisters get their share in the said two properties in my grandfather's name if they claim in a court of law.As one of Our sister married in 1980 is planning to file a suit for share in Grandfathers property Please provide experts advice

Civil courts Rohtak passed a exparty decree for recovery of Rs. 1 lac, there after i filed execution but later on i came to know Judgment debtor have no moveable or immoveable property at Rohtak rather JD have a office in Faridabad, i have no knowledge regarding any property of JD except office having sufficient computers/furnitures etc at Faridabad, now i filed a transfer application for transferring the execution to Faridabad court which is now fixed for consideration , court view is that only on the ground as mentioned by me court cannot transfer the execution to Faridabad, kindly help with citation plz .Regards

I want to file suit for eviction and recovery of possesion aginst my tenant which is govt of india. I have follwing queries
1. maharashtra rent control act 1999 is applicable or not in view of bar under sec. 3 of mah.rent control act.
2. which court having jurisdiction to try the case. Kindly advice.

Is it possible to bring a civil case pending since 2004 to be included in the regular list or are only cases included in the terminal list taken up for hearing?

My dad recently sold a land purchased by him. The purchaser will going to register the land in his name after making the full payment. The purchaser party is asking my father to bring his sons nd wife in the office of registrar for signature. My question is as the property is not of an ancestral type, does the presence of son's are required???
