Please clarify on the following point with citations if any !
A party filed case under Sec 138 NI Act and also on the same cause filed Civil Suit for recovery of the amount . Whether one case( either Sec 138 or the Suit ) Shall be kept pending till other case is disposed !
Please guide in this regard !please mention citations if any available !

In Hrp suit civilcourt passed final order in favour of owner that" The Tenant are hereby directed to handover the vacant possession of the suit premises to the owner within two months from the date of this order". This order passed on 28/2/2007,but the tenant not comply this order still date,during this the original owner sale such property to another person on dated,23/3/2009. Now how can the new owner take a possession of such property.

Madam/Sir,
I had filed a civil suit and on the date fixed for filing of evidence on affidavit of my witnesses, both my lawyer and I were absent from Court. So, my case was dismissed on default under Order 9, Rule 8. This is the second time it's happened. The first time the Court restored my suit. Please help. What do I do now?
Also, is date fixed for filing of evidence on affidavit a "hearing"? Please, please provide judgements, if possible.

Wife has filed attachment petition under Order 7 Rule 1 CPC.
I have two assets. No children.
I am ready to give her one asset. But wife wants to grab two assets. Till now she has no stay order or restrain order from any court.
Dear experts kindly help me how can I save one asset for my food in future.
1) Can I gift one asset to my mother? is there a possibility to wife to take it back?
2) Or Can I sell it to third party? is there a possibility to wife to send notice to the third party to pull him in to the case?
3) Or can I mortgage to some one and register the mortgage document in register office? is it possible to wife to take it back? Can I mortgage when the property is subject matter of a case?
