Change of parential name in birth certificate.

Dear sir, I'm 22 yrs old from chennai tamilnadu. I have a problem in my birth certificate with my parents name where else its been changed officially after 5yrs of my birth in the year of 1994 through government gazette and paper ads as my fathers name: victor abraham and mothers name: saral victor abraham as new names in every documents .

But still in my birth certificate my parents old names are there. its very hectic to face passport office now since they don't accept it different names.

when we approached contonment board of st. thomas mount in chennai they said it cannot be changed. so its difficult forme in getting passport. where the passport office requires the birth certificate cleared with everything..

can u please guide me the way that i shoud go with.. thank you..

Property civit court case

My mother disowned my brother & his wife from property & relation by legaly & publice notice.

but they are living with my mother home. and they are refuse for go out from home.

my brother's wife threat us "if you force that i will file 498a"



what should we do.

Should i go civil court ?

if yes what is the time period of the civil court case ?

And how much cost of this case ?

and what is the effect if this civil court case in 498a case if she file in future ?

Enhancement of rent

is their are any provisions under u.p rent control act on which a landlord can file a suit for the enhancement of rent equal to the rate of land or their are any other grounds on which a landord may file a suit foe rent enhancement.

Promissory note

A promissory note typed in a 50 rupee stamp paper and just below the stamp a heading is typed as "promissory note" and just below it the date of its execution is typed and below it "I........here by Borrowed a sum of money worth Rs100000 from Sri............and which i shall promise to return him on such and such date or with in period of the said date" and below it the man who borrowed the money put his signature and the same is also signed by a independant witness, now the dispute is that is this a promissory note or bond? the matter is in the court will you help me with case laws?, and if it turns out to be a bond then what will be its implications?

Ownership dispute!

Dear Experts Sirs,

Mr. 'A' brought a land ( Plot)through a GPA,in the year 1995.And this plot has changed hands through 4/5 persons, (through sale/registered )documents. Presently i am in possession of this plot with a structure in the said plot.

Now the issue is the family member of Original land owner approached the civil court with a plea that the GPA, through which 1st sale is done is a forged one( On verification it seems to be TRUE.)Most probably he may win the case.

Under these circumstances what i should do, to save my property, which i brought from a person ( after seeing his documents)through a sale/Registered deed.( This pertains to State of AP)

Please Sirs, show me way out to this problem. As problem is very serious one, KINDLY reply me at the earliest, the positive solution / steps to be taken.

Can an applellate authority stay the order of the high court judgement.

dear sir,

i filed a suit for possesssion for my property which had been usurped by my younger brother and running a successful guest house.

the high court decreed that he should pay market rent to me for use of my premises for my residence if i, plaintiff win the case and the suit for possession is decreed in my favour.

the will is probated by delhi high court. the def no 1, younger brother has taken a please of oral family settlement whereby he got the property.

this is all concocted and my elder brother shall soon depose in high court that there was no oral family settlmment. out of the other members one sister is no more and the other one is not appearing for either side.

in a nutshell the def 1 now knows that the game is up and has approached our lawyer through his lawyer for a settlement whereby he shall return the property to me but not pay mesne profits and rent due , which would amount to at least 60 lacs.

i am all against this compromise and would like to battle it out till the end even in the appeal that he shall file.

MY LAWYER OPIINES THAT WE SHOULD COMPROMISE, TAKE THE PROPERTY AND WAIVE OFF THE MESNE PROFITS AND RENT DUE.

HE SAYS THAT IF DEF 1 GOES FOR APPEAL THE APPELLATE JUDGE MAY STAY THE ORDER AND THE CASEE SHALL LANGUISH FOR YEARS TOGETHER.

I HOWEVER FEEL THAT WITH THE CHANGED ENVIRONMENT DUE TO THE ANNA HAZARE CAMPAIGN AND THE NEED FOR A JUDGES ACCOUNTABILITY BODY, WHICH SHALL BE SOON IN OPERATION, THIS IS EASIER SAID THAN DONE.

MY QUERY IS:

IF THE SUIT AND COMPENSATION OF SAY 5RS 50LACS IS ORDERED AT THE HIGH COURT DOES DEF 1 HAVE TO PAY IT BEFORE HE FILES AN APPEAL TO ME.

WHAT ABOUT THE USE OF PREMISES FOR THE PERIOD OF USE AFTER PAYMENT OF RENTAL DUES TILL SUCH TIME THE APPEAL IS DISPOSED OFF

CAN A JUDGE IN THE APPEAL CASE FORCE US TO COMPROMISE AND IF I DONT, STAY THE ORDER.

sir,
my father make a registered gift.but after the gift is done.we found that the market value written in the gift is much less than actual market value.
what i will do now.
will my father have create a freshly new gift?

Gym shut down at 2 days notice, not responding to refunds requests.

Dear Sir,

I am a member of a Gym,at Mumbai.
There are 500 members in the gym.

On the 28th,August,2011, the gym pasted a notice, that from the 31st,August, the gym, would be closed forever, and members, have the options to transfer to other locations.Other branches/locations are not convenient to members. The management, is not responding to refund of membership requests, and personal training fees collected by them. Some members, have even joined only one or two month ,before.

Please advise, what recourse,do we have, and which is the appropriate forum, to lodge a complaint, in the event the gym,denies refunds.

Suit for declaration between legal heirs & against vendee

DEAR SIR
IN A SUIT FOR DECLARATION PLAINTIFFS(LEGAL HEIRS) HAVE SUED OTHER LEGAL HEIRS AND ONE VENDEE ON THE PRETEXT THAT THE LAND HAS NOT BEEN TRANFERRED AS PER REGISTERED WILL HENCE THE LAND BE DEVIDED AS WILL AND SALE DEEDS OF THR PORTION OF LAND SOLD TO VENDEE BE DECLARED AS NULL AND VOID.
BUT IN FACT THE LAND HAS BEEN DEVIDED AS REGISTERED WILL AND THE PLAINTIFF IN CONNIVANCE WITH OTHER DEFENDANTS HAVE FILED THE SAID FALSE SUIT.
NOW THE CASE IS FIXED FOR WRITTEN STATEMENT.
PL TELL WHAT SHOULD BE DONE AS PER LAW TO DISMISS THE SUIT AT THIS STAGE.

Dispute in ancestral property

A father has 7 sons and two daughters. The partition among him and his first 6 sons was done in 1952. All the properties he inherited from his father. After partition, 7th son and two daughters were born. He died in early 1960s.

His wife, 7th son and two daughters were holding the share (a house and 4 acres of land) of the father he got from the partition. His wife expired in 1980s. The two girls were married in 1970s and 1980s.

Now the 7th son is holding the fater's share. Also 6th son is holding a portion of the house for the last 30 years. Now the 2nd son has filed a suit in court and claim that he is having equal rights in father's share. My questions are:

a) Who are the people having the right in father's share? 7 sons and two daughters are having equal rights? Only 7th son is having full right? Only 7th son and two daughters are having equal rights? Is 6th son having any special privilege on the house since he is holding a portion for long time?

b) Second daughter have one son and one daughter. She left his husband and lived with the mother and 7th son. Then she left along with her children. Afterwards, nobody knows their whereabouts for the last 15 years. Can the daughter and her children be considered as legally dead? or they can come at any time and claim the rights? If the property is divided among all equally now, what should be done on her share?

c)In the partition on 1952, the shares are not equal. The 3rd son got very less. The father's share is more than two times than 3rd son. The 2nd son's share is more than 3 times than 3rd son. All other sons got almost equal by average. 3rd son is not alive now. Can the son of 3rd son mention this reason now and ask for more share in the current property or ask the 2nd son to compensate his father because the 2nd son got three times more?
