Ilr 1996 kar 3693 is reversed, distinguished or overuled?

Please tell me whether ILR 1996 KAR 3693 is reversed, distinguished or overuled?

This citation (from Karnataka high court) says declaration of caste before civil court is maintainable.

But - AIR 1995 SC 94, AIR 1995 SC 1506 and AIR 1997 SC 1199 says civil suit is not maintainable before civil court. Please let me know above querry. Also tell me some other rulings from karnataka or supreme court which clearly says civil suit not maintainable.

Property dispute

My father has 3 brothers.We have 3 properties which have 3 brothers as owners and 2 properties which have all 4 as owners.One brother creates problems while it comes to separation of property.Which is the best solution to go for a separation of property ? Is there any court werein 1 of 4 brothers can file for family separation and court will take the hand over of properties and make a settlement,which will be mandatory for all 4 brothers to abide?

Property dispute

Sir,
With reference to your advise on y case from lawyers club India I am sending an overview of the case.If you could advise me I will be highly obliged.

"This court case pertains to my mother vs my maternal uncle (mother’s brother) & his father in law.
2004-Facts are-My mother is one of two sisters and have one brother.My maternal grandfather had ancestral property which was transferred through a sale deed (without any sale consideration-no proof exists of money transfer) to my maternal uncle by his father in law-on the basis of power of attorney granted by my maternal grandfather. No part was paid to my mother or her sister. Subsequently my maternal uncle sold some of the property but did not pay anything to his sisters. Further he transferred majority of the property again to his father in law on the basis of a POA.
2004-A complaint was made regarding this by my mother u/s 406/420/120-B IPC.Both defendants (my maternal uncle & his father inlaw) have been declared proclaimed offenders now. It is pertinent to mention that both of them have been living in Canada since many years.
Now my queries are-
1. What should be the nest course of action?

2. Can we move an application in the court requesting that previous registries of land be cancelled and my mother’s share be transferred in her name.

3. Can we inform the Canadian high commission/consulate of this case and request them to take note of the fact that these people are proclaimed offenders.

4. Is there anything which we can do to expedite the proceedings?

Any further advise will be highly appreciated.

Gift deed

Hi All....Experts' Advice needed...:)

My mom has done a gift deed to my sister (both are alive), but my mom is not happy with the deed, as it was written and formatted by my sister(and her lawyer) and without my mom's full knowledge and was signed on some urgency situation. But now my mom wants to cancel the deed and redo the same with her complete knowledge of the draft.
1). Can she cancel this deed?
2). Can she redo the same with her full consent?

Interpretation of "predeceased"

Dear Sir,
1.My grand father had ancestral house.
2.He had a daughter who died in 1955 i.e. before commencement of Hindu Succession Act leaving behind three sons.
3.He had one son(my father)who expired in 2007 intestate.
4.My grand father expired in 1966 intestate and grand mother expired in 1989 leaving a will bequeathing a small part of the property to one of the three sons.
5.Now the sons of sister of my father are demanding 1/2 share in the property in addition to bequeathed part of the property being sons of predeased daughter as class one legal heir under Hindu Succession Act.
QUERY :

1.Whether Hindu Succession Act will apply to the daughter who expired before 17.6.
1956 i.e.when HS Act came into force?
2.Whether claim her sons is aadmissible?
3.Afetr the death of my Grand Father in 1966 i.e.till 2010 (55 years) sons did not claim their share,whether any limitation will apply?
4.Will it make any difference if the property was self acquired property of my grand property? or joint Hindu family property?
5.Kindly differentiate between Ancestral property,Coparcenary property and Joint Hindu Family Property in particular when it comes to succession.

Kindly favour me with your early reply with case laws.
