Sworn affidavit

Dear Sir,
Does a sworn affidavit - made on a plain piece of white paper as against a non judicial stamp paper, but notarized and filed in a proceeding in a court of law - carry any weight? Can it be taken on record and the presiding officer of the Court act favorably on such affidavit? The judgement given by the presiding officer on the strength of such affidavit is valid? Can such judgement be contested?

Please help me with your expert opinion

Action against govt officer

Sir,

We have staying in a Housing Society for a long time. We have had a problem of drainage system for which I came to know that a Completion certificate can't be given to Builder unless he has completed all the facilites, connections etc. by the local corporation office.

Since our Society's drainage work is incomplete and the builder has got completion certificate, can we take action against the Corporation's respective authority who has give the certificate as well as against the builders. If so what is the procedure for that?

Land dispute

sir i am having a land of 1 bigha from which 5 biswah is of another person. we both have taken this land from another person, we made a house road side of land. in front of road the land is 72 feets.our house is near about 10 year old.
the pather is asking for 1 biswah of land in front side of road about of 36feet.
i want to ask according to law how much front he can have. i think 18 feets.
there is nothing about it in registory.

please mail my query i m very thankful to u.

Extended portion -porch in closed street

Sir

1. In a street the Resident A double storey building front gate is on the other side but his house back side room he has door which opens in a blid/closed street. Resident A has extended Porch of his back side first floor room to the closed street.. The next adjacent house to Resident A is resident B's house whose front gate is on the closes street. resident B has renovated his house and now extended side porch of first floor bathroom, which now extented portion is on the top of resident A's house extended porch on the closed street.

Q. Whether extended portion of first floor bathroom porch of resident B Comes above the resident A Porch is legally correct as per MC law.
Q Whether extended first floor room porch of resident A to the side of back side of closed street is valid as per MC Law. The dimension of porch extended by both residents are 2 foot on street.
Q Resident A whose front gate is on other side, but wants to park his car on closed street even though it is his back side.

Court marriage

I have done court marriage in civil court of Duddhi, U.P. through notary papers. After marriage I have handover her to her parents. Now, some advocates are saying that the marriage through notary is not legally valid. Her parents does'nt know about the notary paper. We both can't live without each other. Her parents are not agreed for marriage because we both are inter cast. Please give me suggestion that how can I proof my marriage legal and how to convince her parents.

Demanding a police office for an identification card

Hello Folks,

I did see another post on the same topic however did not get any supporting documentation on this.

I was charged with misbehaving with police office (and threatened that my vehicle would be seized) for just asking a constable for his Id card. I was forced to the police station and his superior the station SI's claim was i was not an IPS office to have the rights to ask him this, nor was he liable to show the same as he was in uniform. I was very disturbed by his behavior and would like to know what the legal stand on this is.

Service matters

This is a case of dispute in seniority in a grade. The authority finalised the seniority list of a particular cadre officers after giving opportunity of being heard (30 days time). The aggrieved party filed a petition before the State High Court. After completion of court proceedings, hearing, arguments, etc., the High Court reserved its judgment. But till today even after more than three months, the High Court has not pronounced its judgment. I want to know for how long can a Court continue to keep the judgment reserved. What are the circumstances under which Court compels to reserve its judgment? Is the delay in pronouncing judgment not amounting to denial of justice?
