ARE THERE ANY JUDGMENTS GIVEN WHERE A FLAT OWNER ENCRPACHED INTO THE COMMON AREA WHERE HE HAS NO TITLE TO THE LAND

I am working in a statutory body which is working under the administrative control of Central Govt Ministry of Govt of India.
The office intends to hold Departmental Promotion Committee (DPC) meeting for interview for promotion of scientific cadre officers to various scientific posts like Sc` E` to Sc`F`and Sc`F` to Sc`G`on the basis of their ACRs for the period 2005 to 2009 under old FCS(Flexible complementing scheme) of DOPT/VI pay commission.
The office informed me in June 2011 that my grades from ACRs are below bench mark and can appeal for upgrading the ACRs for considering my name for promotion. Accordingly, I submitted my representation for upgrading my ACRs. The office did not give me any reply in writing but when I asked verbally, I was told that my ACRs are not being upgraded.
Now office is going ahead with interviews in Delhi on 22nd Dec 2011.
Incidentally, the present interviews are being held under old FCS though the new FCS had come in force wef 01 Jan 2011 as per DOPT circulars. Therefore if I miss present chance of interview, the next chance will come when, is not known especially when new FCS is not being liked.
Can I go to court in Delhi tomorrow ie 21 Dec 2011 that as officially my representation for upgradation has not been replied and therefore I also should be allowed to appear in interview on 22 Dec 2011.
Or simply the court may not entertain my pray that since your marks are less than qualifying marks for appearing in interview, you have no locus standi.
Any definite help given is welcome from a Delhi High Court advocate.

Learned Advocates,
Please advise on the following:-
My father passed away 15 years ago leaving behind a registered will. Till last 15 years the legal heirs followed the will for mutation,and all other legal matters.There are also undertakings given by them by them.
But now one legal heir has hatched a conspiracy and wants to derail the probate of registered will. He is taking a contradictory stand in comparison to the last 15 years.He is also trying to influence another legal heir for his ulterior motives.
I have heard of "delays & laches". Can learned advocates advise as to how this matter can bounce back on the one or two legal heirs who isn't/aren't following it now because of his/their ulterior motives and collusion and connivance with outside builders etc.They didn't initiate any action earlier.ANY JUDGMENT WILL BE HIGHLY APPRECIATED.

Dear Sir,
Suit dismissed for default. Thereafter the plaintiff filed an application for restoration of suit which was allowed on condition that the plaintiff has to pay costs to the defendant on or before a date as stipulated by the trial court and posted the suit to some other date for report of compliance of terms by the plaintiff regarding the payment of costs on the restoration application.
In this regard, my doubt is whether the order passed by the trial court on the restoration application for restoration of suit will come into effect: (a) whether from the date of the Order passed on the restoration application; or (b) whether from the date of the order passed after recording the compliance report by the trial court.
Kindly clarify this aspect.
If possible kindly provide me any Citations to that effect for which I would be very much grateful to the learned Experts.

I filed suit for recovery of amount under pronote. The suit was filed on last date of limitation. As last two days are being holidays I filed the same on the very next working day. The suit was returned on twice for complaince of some objections. Ultimately, the suit was returned after one month for want of pecuniry jurisdiction and a docket order passed to file into proper court. After taking return of the plaint I filed the suit after 5 days in proper court. Can the limitation is saved. If, so please send the citation if any.

After my husband's death, I am getting tortured by the insurance company. We have a huge house loan. The loan commencement date was Feb 2010. My husband passed away on Sec 2011 in cardiac arrest. He had heart checkup on May 2010, July 2010 and Nov 2010. He had HOCM which is a genetic heart issue, but not life threatening. He was completely healthy and didn’t have any heath issue. He died suddenly without any prior warning. On 2009, SBI life did their own kind of Medical including ECG before giving the insurance. Now they declined the claim saying my husband didn’t declare about the heart issue when he applied for the insurance. I don’t know what kind of medical they did and what is the value of their medical. This exclusion criteria is also not written in the SBI life insurance document. I am totally disappointed.
SBI life made me to run first for the claim, 2nd for the investigation they did. I am totally tired. Now they are making all these excuses. Please help me what to do.

I entered into a sale agreemnet in feb 2011 with a deadline of june and purchaser has not returned and when asking him he said that he register my house by paying the amouunt including intrest, but i cannot wait as i need to fulfill my personel commitment (i also informed the commitments to purchaser), i want sell my property to any other party can i do that? does the agreement is still alive or void?

Dear Experts,
If i want to register my Immovable asset to my wife, what is the procedure, whether i need to pay the Stamp duty and registration fee for the same ?
2) Can i add my wife's name as JOINT Account to my immovable property ? If Yes what is the cost involved.
3) If i add my wife's name, Then after my death, what will happen, whether entire property will go to my wife's name, OR, My children will claim their share in my NAME ?
