Hello Sir / Madam,
Need your help on understanding about a situation with a property..
My grand father has expired and he had left a small house in his native city. My Grandfathers' 2 daughters and one being my mom and other her younger sister.
So legally how to divide the property,
1. Will that to be partitioned equally between my mom and her sister
OR
2. As Grand children we are three, to my mom - Myself and my younger brother and my aunt has one son. So as grand children can we divide the property into three?
The reason why am asking about this is because it would be nice to know which would be the best practice.
Looking forward for experts advise.
Thanks,
Ravi Kumar

Below is the order of high court .please suggest how to delay the proceeding in the Trail court.in other words objections filed to hamper the speedy execution.please suggest in non legal language.
'As regards the imperfect title, defendant was required to take certain steps. If he has not
taken such steps then, it goes to his dis-advantage and show that he had a guilty mind at the
inception. The defendant cannot be permitted to take shelter of certain niceties which has
nothing to do with the plaintiff. If he on his own has not performed, then he had the guilty
intent and one who nurses such intent, cannot claim any advantage in a court of equity while
exercising jurisdiction of grant of specific performance. The courts are required to look into
quantum of equitable circumstances which heavily weigh against the defendant. We are of
the opinion that the plaintiff is entitled to grant of decree of specific performance. We are
remitting it back to the Trial Court to detail out the niceties of execution of the sale deed in
favour of the appellant in terms of the agreement on which we are ordering the specific
performance. The exercise should be completed within three months'

I am working in a organization of Central Govt Ministry of Govt of India.
The organization held Departmental Peer Review Committee (DPC) meeting for interview for promotion of scientific cadre officers to various scientific posts like Sc` E` to Sc`F`and Sc`F` to Sc`G`on the basis of their ACRs under old FCS(Flexible complementing scheme) of DOPT.
The regulations of the organization states as follows :
``The Departmental Peer Review Committee shall consist of the following:-
(a) Secretary, A (host organization) - Chairman
(b) Secretary, B (X 1 departt of GOI) - Member
(c) Secretary, C (X 2 departt of GOI) - Member
(d) Director, D (X 3 departt of GOI) - Member
(e) Director, E (X 4 departt of GOI) - Member
(f) Secretary, F) (X 5 departt of GOI) - Member``
Now on the day of interview, 2 members (say B & C) did not come for interviewing for some reasons. The interviews were held by chairman + 3 remaining members. There is no definition of quorum given in above clause.
1. Are the interviews held can be called legally correct for promotions
2. Or in the absence of 2 members, court can be appealed for quashing the above interview exercise as null and void

Whether filing fresh Writ petition seeking direction for framing scheme for adhoc employees will going to help him
I am not expertise in service matter but I have contested the case of my close relative who was terminated/discontinued from “Medical Institute after nearly serving on adhoc basis for nearly 12-13 years before CAT. The CAT rejected the petition by citing 5 BENCH order passed by Supreme Court in State of Karnataka vs Uma Devi citation SCC 2006 given by 5 bench judgment
I made an appeal before High Court and has raised in different manner that he was only singled out from the rest of the 199 adhoc employee who are working in B & C categories. The H.C gave time to the respondent but again it was dismissed by citing the same order passed by S.C
I think its worthless to approach before SC as the order hass already been passed by 5 member bench and has little hope of receiving any relief. I saw many judgments of SC which too has been relied on the same without going into other peculiarities
I came across through various RTI Applications filed by him and I surprised to learn that Institute has regularized the services of Group D employees in regards to scheme evolved by standing finance committee on 2008 while no policy has been evolved for B & C category employees under which my relative was placed as result the status of the adhoc employees placed under B & C category. The policy makers were well verse with the decision passed by the SC passed in 2006 in Uma devi case(supra) and yet they have evolved the policy for D category employees only by compromising the merit..Whether filing fresh writ petition before the HC seeking the direction for framing scheme for adhoc employees working in B & C category will going to help or should I filed the SLP befoe the Supreme Court of India
