Hello,
A was making payments of Rent to B by cheques for which no receipts were issued to B till December 2008.
From the Year 2008 to 2011 A made excess payments as Advance Rent to B which were much more then the Rent payable .
During the course of the case proceedings B claimed that -
a)All payments of Rent are cleared till 2011.
b) The excess payments made during 2008 to 2011 were regarding earlier default of Rent payments which were cleared by A during the period 2008 to 2011.
During the cross examination A stated-
1) He has not maintained any records prior to 2008 as the same were not required by the Indian Limitation Act as those related to more then 3 years and
2) No notice was sent by the B regarding any dues prior to 2008 so he does not have records prior to that .
Will his statement stand in the court of law.

Dear Sir/Madam,
3 cases under section 138 of N.I. Act had been filed against a proprietorship firm for a claim of total sum of Rs 13 Lakhs more than a year back. During the course the accused has paid back Rs. 9 lakhs and 2 cases have been closed. The amount now outstanding is Rs. 4 lakhs. Recently the accused failed to show up in the court for the last two hearing date and the court has issued an arrest warrant against the accused. The next date of hearing is on 20th April. The accused is now unable to pay the rest of the amount as there is virtually no source of income or property with the accused. However he wants to explore the option of paying the balance in installments if it is possible. What should be done for the arrest warrant issued as the accused fears that he might be arrested when he appears in court. What are the chances of court accepting the plea of accused to accept payment in installment? Are there any previous examples where payment in installment was accepted? Are there any other options for the accused since he is financially broke and with no asset to make the payment?

I stay at kandivili east. I need some information in regards to builder selling car parking to the members of society. I have few questions as mentioned below.
1) Builder has sold car parking (open/slit) to the members of society and he has only given allotment letters. Is this legal?
2) Does the members have the right to say that that car parking space belongs to them?
3) This allotment has not been discussed in the AGM after the society was formed. Other members are against these allotment letters. Do the other members who are against this have the right to go to court and file a case
4) Can a society passe a rule stating that the allotmemt letter is legal?

Consumer forum - exparte order
What are the effect and consiquence of an exparte order against the opposite party, who was alleged by the court for deficiency in service?
If opposite party does not pay the compensation in accordance to that exparte order, what action should be taken by the court or complainant?
