Respected sir,
This is S P Goel. Some person known to me is using my house address without telling me and without my permission in documents like Passport, Visa, car bill, registration certificate of car, car insurance, Life insurance from different companies, Provident fund department, medical policy, PAN number, income tax return, National Saving certificate, Post office savings, Banks accounts in different banks and FD,Public Provident fund, Mutual Fund,mobile connection, purchase of AC etc.
I have sent a legal notice to him on 14.05.2011 for which acknowledgement is available withme , requested to change the address and send me a copy of all with changed address, but after one year, he did nothing.
Kindly give your valuable opinion, guidance and suggestion under which act and which section , I can file a suit petition against him since risk of any mis-happening is mine at present.

sir,
i have given the general power of attroney to another person,,in that POA i have assigned entire power to that person including sale,,can that POA holder sale that roperty in my abense now with out taking my signature.
how can i stop him to transfer the property in my absence witthout his knowledge .is there any way to this this legally .
POA done in 200 stamp paper with my signature and notory signature

Hallo Sir,
I am practicing lawyer of Nashik Dist.My clients father having some agricultural lands bearing his and my fathers sisters name, but all these properties are ancestral properties and my clients name is not mentioned in 7/12 extract. Meanwhile taking advantage of his name some portion of agricultural land has been sold by my clients father before two months without obtaining the consent of my client. So now my client wanted to be declared that sell deed null and void through Court and also wanted to claim partition with injunction by virtue of member of Joint Hindu Family.Is it fine if i will filed asuit for declaration and partition with Injunction ? Please advice me Sir....

my frnd took loan of rs 23 lacs from haryana financial corporation for running a steel unit. i also signd the loan papers as an personel guaranter, i wasn ask to submit or show any of my property papers to haryana finanance corporation. they just askd for sign and i did it.
after two years his factory went into loss and acording to hfc rules they auctiond that unit, still out standing was there and he wasn able to repay , so he was sent to jail for 40 days. same time i also used to get notice from corp to pay the outstanding amt.
now as i dnt have any sort of property on my name, m confused what to do nxt. i want to know weather hfc can put me in jail too? pl help

Respected sir, we have filed first punchnama application in the court under o.26,rule.9,(court comissioner), but the defendents advocate raised objection for the said application so, is there any authority regarding the said provision to grant such application.

Dear All,
I have following questions
The case was listed for admission/denial of documents However, None appeared on behalf of Def a,b,c and the counsel for Def e,f,g admitted the documents filed by the plaintiff.
Whether documents would be deemed to have been admitted by the Def a,b,c? and its consequences?
The def a,b,c are were proceeded ex-parte and ex-parte evidence has been concluded the def a,b,c have moved an application u/o 9 R 7 which is pending.The other defendants are supporting the case of the plaintiff.
The only defense of the Def a,b,c is that plaintiffs grand father has relinquished his share in favor of the father of Def A.
Hence the plaintiff has no right in the property.The alleged relinquishment is based on un- registered document.
The Def a,b,c are delaying the proceedings.
Is there any way the for speedy trial as the case is pending from last 10 years. Can court pass a decree based on the admissions by other defendants. As the suit is for partition of joint family property and Def a,b,c are trying to grab the property. the only question to adjudicate is whether the alleged relinquishment is valid or not.
