Hi Sir,
My Client is karta of Hindu Joint Family. He is having ancestral joint family agricultural land.He is having Three Son and Two Daughters.
Meanwhile between My client and his three son made Unregistered partition Deed of the ancestral agricultural land on simple Stamp Paper of Rs.100 and upon that mutation entry effected and partition also prima facie shown on 7/12 extract.
My client transferred some field of self acquired property before that partition to one son so during partition he got a less share than others.
Both Daughters geting nothing from their ancestral property but my client i.e.father of that daughters ready to devide his share equally in to the name of both daughters.
But Only two son filed suit for Injunction and partition and made averment that their father has agreed in that Unregistered Partition deed that after his demise These two sons are entitled for the share of Father.but Father is illeterate and having Thumb Impression on Partition deed knows nothing about above that clause.
Daughters and one son not made party in suit.and a son not made party is in favour of his sisters/father.
So Can Daughters demand the share of their father by way of Suo motu Application for Addition of party U/O 1 R. 10 of CPC in suit?
Or Father of that plaintiff/Sons By Way of Counter Claim Can ask for declaration that his share devided in Two Equal Shares in favour of his Daughters as his Three son already got their share in Ancestral Property and having no Right in the share of Father.
So Sir please suggest proper remady regarding above facts and if possible suggest some specific provisions with Case Laws.
Thanks,
Adv. Vishal A. Vyavahare.

A AND B SOLD AWAY VACANT SITE TO ONE X BY EXECUTING A REGISTERED SALE DEED hoping that both have right and title over the said property, later B came to know that A DON'T HAVE ANY RIGHT OVER THE said PROPERTY. SUCH REGISTERED SALE DEED IS VALID as per law OR NOT? how can B challenge of the said sale for restoration of his right over the property after the lapse of 10years, and what would the out come of that challenge

In L.E.Suit, filed by brother against me, in Small Cause Court, in Mumbai my brother has asked inspection of my documents, before he gives inspection of his documents; even before he has filed his evidence. Isn't it illogical. It is as if I have prove my innocence (and not that he has to prove his case). This way he will see what documents I have in my possession and make up the lacuna in his case.
I wish to know what is the correct procedure? Should I give inspection first even though he has filed the case?

Dear Sir / Madame
I would like to know whether there is any law/rule/instructions from any higher court regarding proper timing of flag hosting by a judicial officer at Taluka court (J.M.F.C. Court) or My question is when(at what time)a judicial magistrate first class can hoist a flag on republican day...? whether he can hoist national flag before his seniors(the district judge/high court judge)hoist national flag at their respective office premises? or the JMFC have to hoist the flag only after his/her senior do so...?
kindly advise....................

sir, i m in very critical condition, i am living with my 2 yrs old twin daughters at my mother's house since 3 feb 2012, as my husband got drunk & beat me at midnight and he told me to left his house and usually tortured me so much. how can i get my floor but i don't want to live with my husband b'coz i am afraid of him. my husband also own seperate flat. is there any provision to get that flat or my floor? my matrimonial home is owned by my mother in law. or any other option. b'coz my financial condition is very poor. it was his second marriage after getting divorce.
Both the WILLs of my mom and dad were in possession of my sister in which the whole self earned property is given to my sister.I am the only brother and no other brother or sister.
These WILLs were submmitted by my sister to Talathi ( Mahrashtra). With valid doubts,I submmitted my objection. The hearing was called by MANDAL ADHIKARI IN HIS COURT.
After scrutiny of the statements and documents submmited, three hissas were made and endorsed in judgement given by MANDAL ADHIKARI.2 hissas were given to my sister and one hissa came into my possession. After appeal-term of 60 days,Tahasil office has also endorsed the same. But Our society needs court-order for the judgement or mutual understanding between me and my sister.Sister is not ready for either for these 2 options.
Now I want this seperation to be endorsed by Civil Court, because I want to sell my Hissa and go away.
my query is .Can I alone file a separation suit of this property ? (because my sister is not ready. She want this situation to be stay as it is,so that I can not sell my Hissa.).What should I do ?
