this regarding non supportive by experts. I would to say that I am querrist I quench my thirst by thirst when I get the proper answer. When student ask the lecturer a doubt and the lecturer answers the negative way saying that I do not answer the question put by the student the lecturer is not fit for teaching so the experts one gives the query for getting a suitable reply not evasive answers if the experts have got ego then it is upto them to save their ego not the querrist .
Can u tell me some judgments wherein if a cheque, given as a security for performance guarantee, was encashed for the realization of outstanding liabilities (for the amount given as mobilization advances). And the cheque bounced and 138 complaint filed. How to protect the complainant company.??
Thank & Regards

Sir,
My mother died intestate leaving behind myself, my sister and father. My sister on forged Will claimed entire property. I filed partition suit and Court was pleased to partition the property into 1/3rd share each to us. Against this judgement my sister (Defendant/Respondent) approached Supreme Court by way of SLP. We came to know she filed SLP but we never filed caveat petition in the Supreme Court under the impression that my sister will issue notice when the SLP is admitted and her Review Petition was also dismissed. But the SLP was dismissed and the matter was closed.
When I approached Trial Court my sister filed documents claiming entire property through counter claim by forged relinquishment deeds against our Final Decree Order. It has come to our notice that my sister prayed in the Supreme Court SLP for Interim Relief on the basis of additional documents to place on record. In the trial court she has not mentioned on what grounds she approached Supreme Court for what reliefs. I think she must have filed the same relinquishment deeds that was filed in Supreme Court asking for interim relief. When I applied for certified copies of SLP, We were informed by the Supreme Court that they weed out copies after a certain period. Now How can I know what has transpired in the Supreme Court in relation to the said SLP where we are opposite party and litigants to the said SLP and on what grounds of appeal my sister approached the Supreme Court. It is understood that she has played mischief by not disclosing the grounds of appeal in the Supreme Court to the Trial court and stalled the Final decree proceedings for claiming entire property.
Please kindly advise how a litigant can know or find out on what grounds the opposite litigant approached the Supreme Court when Supreme Court dismisses the SLP and also there is no certified copies on record in the court. Can appeal is taken into the proceedings of the present suit for further proceedings or not.
Yours faithfully

Hello Sir,
I am the defendant, and had filed a Condonation of Delay within 90 days. Plaintiff has replied back in written regarding the same and has mentioned tat Defendant shall not be given condonation.
Do I( Defendent ) - need to reply back in written to the court ?
Also the Plaitiff's adv. is asking for a cross examination of defendant, when it has been just 3 court hearings till date, is so early cross examination allowed?
Thanks.

Dear Experts,
‘A’ as a vendor, entered into an unregistered agreement to sell with ‘B’. Accordingly ‘B’ paid the earnest money to ‘A’. On the due date of registration, ‘A’ was ready to perform his part of contract, but ‘B’ was not prepared due to his financial problems. ‘A’ remained present full day in Sub Registrar office on the due date to perform his part of contract & in the later hour got his affidavit of presence attested by the Sub Registrar. However, ‘B’ also managed to get his affidavit of presence attested by the Sub Registrar in the later hours despite of his non-preparedness. ‘A’ through legal notice extended the time for registration of sale deed & a new date after 15 days was fixed accordingly. Again on this date, same thing happened i.e. both ‘A’ & ‘B’ got their affidavits of presence attested by the Sub Registrar. ‘A’ is still willing to perform his part of contract & on the contrary ‘B’ despite of his un-preparedness & by way of giving false affidavit of presence/preparedness, may sue ‘A’ in court, stating that he was ready to perform his part of contract on the due dates, but ‘A’ was not prepared to do so. What should be done by ‘A’ now??

Dear Experts,
‘A’ as a vendor, entered into an unregistered agreement to sell jointly with ‘B’ & ‘C’. Accordingly ‘B’ & ‘C’ jointly paid the earnest money to ‘A’. On the due date of registration, only ‘C’ from the side of vendees came present & ask ‘A’ to execute the sale deed in favour of ‘D’. ‘C’ was made witness to the sale deed. The original unregistered agreement to sell was destroyed after registration of sale deed.
My questions are:
1. Can ‘B’ sue ‘A’, on behalf of a Xerox copy of the unregistered agreement to sell, in which he was also the vendee, stating lie that he was unaware of the said sale deed executed in the name of ‘D’ by ‘A’ even with the consent of ‘C’.
2. If yes, whether ‘A’ is at fault or ‘C’ is at fault or both?

In a Judgement in money suit the judgment say that the defendant is liable to pay the suit amount in installment, and is silent on the part of interest which was also the prayer of the plaintiff. Now when the decree will be prepared whether the interest of 6% will be allowed and whether the decree will include the court fee deposited at the time of filing of the suit and other miscellaneous costs.
