Forced membership or not ...

A Welfare Society was registered under Societies Registration Act in Delhi of an industrial area and in the Rules and Regulations of the Society the membership clause said -
All the owners of factories in this area SHALL be members of the society.

My ques. are-
1. Can a membership of a society be compulsory due to ownership of a plot in certain area or not or do the members have constitutional rights and have a choice to be members of a society or not as there is always a resignation clause.

2.Does giving of subscription is deemed to be enrollment of the society even when no membership enrollment was done and neither eligibility of the membership checked as many non owners also paid subscription and voted.Even the membeship was not passed by Governing Body.

3.The validity of such managing Committees formed where eligibility clause not taken care and everyone whether eligible or non eligible voted.

To my knowledge subscription for basic facilities provided in a certain area and membership are 2 separate issues and membership requires eligibility which has to be checked with ownership documents ...

Thanks ...

Reasons to withdraw

A suit was filed about a fortnight ago where the Hon. Judge has questioned maintainability of the case. Some clarifications were given but it appears that the Hon. judge is not satisfied and time was sought for providing more clarifications. Notice to opposite party has not been issued so far.

Now it is proposed to withdraw the case to re-file the same with proper legal advise. Experts may advise

a) what reasons should be given to the court to withdraw such case so that it can be re-filed later on without any problem.

b)can withdrawal be done by the plaintiff without presence of the advocate in the court as advocate is unable to appear on the next date of hearing.

Bank pre emi

Hi
I need some guidance on Pre-EMI interest calculation and disbursement.
Does the disbursement date means the date on which the bank issued the cheque to the builder or on the date the amount got debited from bank.
In my case the bank issued the cheque on 12/02/2013 and the registration happened on 28/02/2013. The original papers were submitted to the bank on 01.March 2013 and on the same date the cheque for the builder got debited from bank's account.
The regular EMI date is 5th of every month.
Kindly guide whether the Pre EMI interest will be calculated from the cheque issued date (12/02/2013) or from the date on which the money was remitted from bank.

Supreme court decision on rti applicant as consumer

dear sir,

i am informed that the latest position in regards to national commission forum is that an rti applicant is not a consumer, reversing its earlier decision.

i also learn that a certain ngo has filed apetition with the supreme court in this connection.

kindly let me know

1. the latest position

2. does the delhi district forum admit consumer complaints under its own bodies like the municipal corporation of delhi

thanks
