Hi All, i have come to this forum with a lot of hopes of some genuine and helpful guidance. We have been staying in south delhi for almost 60 years and have a house in lal dora areas. We have our own house which was reconstructed with an agreement through a builder. Now the original property was for 180 sq feet out of which we had left 3 feet of the portion in front for parking or other usage for ourselves and at the back for ventilation. Apart from that we own the ground floor and 3 floors of the building. The builder owns the basement out of which he sold one shop to some lady. After my dad expired this lady has encroached on the property through illegal means after my father expired. and she does not let us use the front 3 feet area for parking as she says that its her place because builder gave in writing to her. The builder has also given in writing to us that this area is of the landlords and has not been sold to any one else. This lady has contacts in police and now she denies to let us have the rights on our property. The police is also favoring her and she threatens me and my family that she will not let us have the property. She tell s police that my brother who is just 17 years misbehaves with her. its been 7-8 years that we couldnt do anything due to financial conditions but now we cant tolerate this and need help. We are scared that she might harm us aswell. My mother is going through a bad time and is a high BP and depression patient. please advise what can we do. Many thanks

Kind attn.Mr K.Mahesh,Mr.prabhakar singh,mr.Devajyoti Barman,Mr raj kumar makkad. In continutation to my previous query,as you sought more information (adding here)
sir ,i have my parantal house on main road in city.In front 7 shops are on rent(65 feet front) ,one passage (5 feet)on road side.I had purchased 3 shares out of total 5 from my brothers ,so i m owner of 4 shares now.One of my sister has claimed her 5th share in court ,which i m agreed to give her .But she want portion(65 feet/5=13 feet front on road) having passage on road instead of portion in her custody. In court ,proved that she is taking rent from tenant shopkeeper in her custody.
Can she claim another portion ,which is not in her custody as per law?
Only one share holder has passage ,what other 3 will get ,if this passage given to her by court??
Is court bound to give her passage from road side when all shops are on rent except 5 feet passage on road??
1There is no written agreement on division. My sister has filed case in court for getting share which i had got evicted from supereme court on personel necessity.
2.This passage is common and all share holders are taking rent from their shopkeepers. This is commercial property.

I have taken an education loan from Syndicate bank of less than 2.5 lakh, and was aware that no security is required except for parents guranteefor loan below 4 lakh. however as it was extremly important to me then , we agreed with the bank to also keep a LIC policy with them of around 1 lakh as gurantee. It was explained to us that as that is not a mandate as per govt law, it is only for the purpose of getting the loan approved, and the same will be given back to us on maturity. The maturity date being before the completion of loan repayment date. Currently i have only about 60,000 due to be paid to the bank and they have nicely stacked our LIC maturity sum which got paid this year. On contacting the bank to release the amount, thay said they cant do so and there is only one option of getting the loan settled with the LIC, amount. i have been paying all my EMi's on time and have always paid all the amount on time. I do not understand how they can go back on there words, only because all the initial staff who gave the loan have left. Kindly help me to understand if i can charge the bank to pay my LIC amount, while continuing to pay my EMI's as earlier, as this money belongs to my parents. Please help.Let me know if you need any more information on this to guide me. Niket-9765900094

whether civil court has jurisdiction to handle the case regarding shares and securities? as the matter is that the shares sub broker has counter filed a civil suit against our civil suit of demanding genuine bills and contract notes later on sub broker found to be un regd sub broker as the SEBI issued letter for the same and the transactions found to be un correct by SEBI now the latest status of the case that civil court has ordered in both cases to go to competent authority.even then the un regd sub broker go to high court for stay on it now my question is why court entertains such un authorised person? what should i do to get myself to be out of it and is there any judgements regarding that the civil court has no jurisdiction for shares securities transactions related cases as arbitration facilities r there and we could not go there as we have not been given bills and contract notes now please kindly advise what to do ?

Bldg redevelopment
Our bldg had signed the development agreement with a particular developer more than 2 yrs ago. however there has been no progress on the same. As the DCR has changed, we asked the developer to make a supplementary agreement with certain changes as compared to the original DA.very recently. The developer says that he has obtained IOD 1 and IOD 2 is in progress.
He will allow us to view the approved plans n IOD 2 but will not be able to give us a copy of the same. He says that these things will not be attached in the main DA or the supplementary DA. Also, he is reluctant to make individual agreements. He expects us to vaccate by just viewing the IOD 2 n the approved plans.. He says that commencement certificate will come much later.. he has released 50 % of the corpus payable to each member 2 yrs ago and he says that he will release the balnce amnt of corpus and advance rental monies shortly. Is it advisble to vacate without attaching the aproved plans or say other approvals to the supplementary agreement ? Is individual agreemnet necessary if one wants to sell the flat post redevelopment ? Kindly advise
