Hello Experts
My father had construction material and he is staying in city ‘thane’ and the material was dispatched to a supplier “A” at Mumbai & an agreement was done. My father was given monthly rent on those materials for a few months but later supplier cheated and we stopped receiving rent. On repetitive chase, we came to know that supplier had further rented material to a 3rd party who had ditched on the payments to the supplier.
The agreement between my father and supplier “A” had two conditions as follows:
1. the material will not be transferred to any third party
2. all disputes for money & material will be settled through arbitration.
This supplier has cheated us, there is a breach of contract too. Equally the supplier has filed a private suit against the 3rd party for recovery of his money where my father is not a party.
Please assist me with below 2 points:
1. Can my father add himself as an obstructionist or as a new party in the suit between supplier & 3rd party as his material was secretly given to 3rd party. This suit is at Mumbai
2. Can my father file arbitration proceeding at Thane (reference section 20 CPC which states part of cause of action at Thane as material is supplied from Thane & my father stays at thane)..All other legal formalities of earlier agreement were done at Mumbai.
Please advise

Hello,
I had a query yesterday and got some good reply. To a drill down to my query further:
1- My client is an LLB graduate and was earlier practicing in a dsitrict court.
2-He is currently working as a teacher in a private college which is affilaited to State university.
3-Due to pending case, my client is defending an ancestral property civil case (Title Suit) in the district court. The property belongs to his mother who has given him a General Power of Attorney and it is registered. The PoA specifies that he can represnt his mother in a court on her behalf as mother is 70+ years with health issues.
The query is
a)As he is working in a private affiliated college and also defending his mother's case, is it legal to represent his mother's case?
b)Is it a case of double employement?
c) If his defending the case is legal, then under what CrPC, CPC section can he continue to teach in a private college and also defend his mother's case.

My father died last month leaving behind my mom and us two sisters. He had a DDA freehold MIG flat. The conveyance deed was in his sole name. We all three want the flat's title transferred in our joint names. Which is the authority in Delhi we should approach for this. Kindly advise.

Sir, I am a retired employee. A tenant in my house joined about one and half year back has been troubling me, not paying rent in time, not vacating the house even after telling several times and dues are accumulated. When I demanded for payment of dues immediately, he uttered words in abusive manner using filthy local language. Besides staiying unauthorisedly without paying rent dues, he tried to tamper the power sub metre, drained the water from taps leading to unavailability of water to others, and also causing damage to the let out portion of my property. When I tried to stop him from such acts, he alongwith his wife and chldren manhandled me causing bruises and cuts on my body and gave a complaint to the police colouring the things in different . I also gave a complaint to the police giving the facts. The police instead of registering my complaint, advising me to come to compromise viz., accept payment of dues as and when he wishes, provide him amenities, allow him to vacate house as per his wish and cautioned that I will further loose if I prefer complaint registration and subsequent followup of procedure including court case. In view of the above, I request you to guide how I can protect my interests and what the relevant laws say on these type of cases. Thanking you.
In a matter relating to demolition of an illegal and unauthorized construction the party got a status quo on a crp filed by them against the orders of the 3rd Addl. Chief judge. Its almost 3 years and the case has not come Up for hearing, Me being the first Complaint and as the crp is between the party and the corporation; can I do anything to get the unauthorized structure to be demolished. Has the status quo has no time limit?
