No care

A filed a civil case against B. Summons were issued to B to appear on 10.5.2013. Summons were duly served upon B. However, Hon.Judge was on leave on 10.5.2013. The court staff asked whether A and be were present. While A was present, nobody came forward from B's side and next date given is 4th July, 2013.

Now, please advise

(a) how non-appearance of B on 10.5.2013 would be taken by the court.

b) what will court do, if B does not appear on 4.7.2013 also.

Appointment of advocate in a society

Dear Experts,

Mr. X is an advocate. A flat in Co-operative Society, Mumbai is in the name of Mrs X. who is also a member management committee.

Can the society appoint Mr. X, an advocate to represent the society? Does it amount to conflict of interest? Because Mr. X & Mrs. X are creating lots of problems among the members through continues litigation.

Thanking you,

Regards,

Police investigation and civil case

my father's deceased first wife's children have forged my mom's signature and have got a partition order from the court without our knowledge. my father gave the properties to my mom through a gift deed. they have no claim whatsoever. we have put a set aside petition in court. we also lodged a complaint in police. but the advocate of the opposite party told the police that they cannot investigate an ongoing civil case even for forgery. with their court order they are trying to throw us out of our home.it is clearly a fraud case and we have the documents to prove so. is there no way for the police to investigate this case and file an FIR?
