I have filed Suit for recovery of money being the amount due and payable by the Defendant by way of reimbursement. However, Suit is dismissed for default because of negligence of my clerk as he did not note the date in my diary which was not deliberate action.
Now, I have filed Notice of Motion praying restoration of the Suit.
I need relevant case laws in this regard. I am giving few points regarding my case.
1) Suit is dismissed for default.
2) Suit is undefended.
3) No delay in filing the Notice of Motion.
Is there any possibility to restore the Suit? Kindly provide me relevant case laws if any.
Thanks in advance.

I am a parsi girl by birth but married to muslim and have twins. we are living with my parents since my in-laws' house is small. my parent's house is located in parsi colony which belongs to the parsi trust. so the house is rented, i.e. my father pays monthly rent. this flat in which we r living currently is under litigation since the past 25 years, and my father lost the case just this month, since a suit decree was passed in favour of the appelant. now my father is planning to file an appeal against the decree.
I want to know the following:
1. Once the appeal is filed, can the trustees file for "Mesne profit" ?
2. Is mesne profit applicable to my father /
3. if we have lost the suit, is it necessary that we will face failure in the appeal too ?
4. If we lose the appeal, can i file a seperate suit and fresh suit against the trust or trustees in my name or my husband's name ?
5. i being a legal heir to my father, will i be eligible to fight the case against the trustees if my parents remain no more ?
Kindly reply to all my above queries, since i need a clear picture of the above facts.
Thanking you,
Mrs. D.M.Merchant.

Dear Sir/Madam,
I was using Reliance Wi-Max some two to three years ago when I was in Pune. After five-six months, I discontinued the service and switched back to another Internet provider. Now, I don’t live in Pune anymore, I moved back to my hometown, since July, 2012. I think, I have settled the last billing amount. I have provided my E-mail ID at the time of applying for connection. I haven’t been contacted by Reliance for the last 2-3 years. Now, out of nowhere my friend (who is currently living there in Pune) have called me and told me that, you have got a “Pre-litigation for the outstanding billing amount of Rs.1541/-“from "Pune District Legal Services Authority, District Court, Shivaji Nagar, Pune" on the given address. I am asked to pay the claimed amount on 22/09/2013 at the time of hearing at “Pre-Litigation Mega Lok Adalat”.
Anyways, I am ready to pay the amount. Do I need to go for the customer court to meet “Pre-Litigation” Or this issue can be resolved by paying the outstanding amount at the nearest Reliance center??
Pleased help me on this. Thanks in advance.
Regards

Please advise how justified and lawfull or unlawful it is, to write the words "POLICE" or "cop" on the private bikes or private cars owned or not by the Police Employees in west Bengal ?
It has become very frequent practice in West Bengal to Write these words on bike or cars, as a result these bikes are treated differently, and allow privilege on the roads by the Traffic Police.
Please also advise if anything can be done to stop this.. Unlawful things should be stopped na ?
Please stand against this undue privilege..
