dear experts,
i am for the plaintiff filed a case for recovery of amount on the basis of promissory note executed by the defendant. actually defendant executed the pro-note as he admitted out side the court ,but denied in the court.in support of the case the plaintiff examined as PW-1 and PW-2 who the scribe of the pro-note and said that transaction took place before him and consideration also passed before him on the same day.the defendant sought for sending the expert opinion and the report came showing the same is forgery.kindly advice on this on behalf of the plaintiff with suggestions.THANQ SIRS.

How long time taken to get the judgement for writ petition in madras high court?
arguments are over but the judgement was not given...writ petition filed in the january 2013. please help me how to get the judgement earlier..I fear opponent party will do any fraudulent activities,before the judgement came. Please help me to get the justice..

One of the Cement company has offered cash discount by way of passing credit note on bulk purchases. in pursuance of the offer, a buyer (Infra company) had released P.O for bulk purchases. but the Cement company has defaulted to make the cash discount to the Buyer. Can we file a consumer complaint against the cement company to recover the discount amount from them....pls clarify the legal position.

Respected Experts of the forum,
I am fighting a partition suit with my brother. *Ist Addl. District & sessions Judge of the district court granted interim injunction pending trial of the main suit. On this the respondents appealed to High Court and managed in deletion of some property,the High court allowed the appeal PARTLY to the extent of 4 properties only.
Now my problem is ,on finding some third party constructing a House in SUIT( Which is under Injunction, as detailed above) property, without valid ownership ( with cooked up documents, which they submitted to the Ist Addl. District & sessions Judge court ), i approached the Ist Addl. District & sessions Judge for stopping the construction. But ,Respondents managed the court and i could not get any relief. Then i filed CMA in HIGH COURT.Even here the HC Bench ,without seeing the respondents claim of the owners ship; taken a view that Construction work cannot be stopped at this stage ( Only frame work of Building is in progress) but instructed the Respondents not to claim the Building if they loose the case in session court (ie Ist Addl. District & sessions Judge court).
Would the EXPERTS of the forum, kindly tell me the view taken by the COURTS is right if yes, please GUIDE me with alternatives i have?

My company sent me for deputation work to USA for two months at previous year (2012 July & August) and I signed a bond also. This bond duration period is two years. If I break this bond they will charge me the complete expenditure with 18% interest. In that bond they mentioned that Civil Courts at Bangalore alone shall have exclusive jurisdiction, in case of any dispute arising out of this agreement. I heard that in India employee bond is not valid. Is this correct? Please suggest me If any possibilities to break this bond.

Dear Sir, the child custody case (GWA Act) which i filed in district court, chennai went ex-parte and is in final stage( Status : requires further evidence). At this point my ex-wife stayed this case by filing the transfer petition in SC and i have no objection for the transfer. If the child custody case is transferred then whether the case will start from the beginning in another court or from the point where it got stayed? please help.

plaintiff file a title suit with permanent injection before civil judge ( junior division)defendant want to construct house over the disputed land / plot. plaintiff file a temporary injection under order 39 rule 1 and 2 of the CPC. the court reject the said injection and issue the notice under order 39 rule 3 of the CPC. can plaintiff file writ in the high court for the injection?
if no then why he can't file?

x,y and z are person. x sale his property/ land / plot between y and z as equal share of each. if y get pata of the total area, which x sale to y and z, by way of mutation before tahalsildar but z does not know about that. in the mean time y construct house over the said plot / land. when z know about that matter he file a mutation appeal before the sub-collector.
my query is if z win the case is he entitle that house which is construct over his space?
if yes i need judgment of over this.

After the judgement...
I have a case finalized in my favor of tenant / landlord in which i was a tenant and the file was consigned to the Record Room.
I had given a Fixed Deposit as security deposit of rent in dispute during the case as per the order passed by the Court.
1.Now as the file is consigned to the record Room can I move an application to the same Court regarding the release of my Fixed Deposit.
Under what Section or Order will i have to move this application.
2. I have received the Certificed Copy of the order , do i need to do any more act/s regarding this case to close my personal file and just pay normal rent in future to the landlord which was earlier paid in the Court or any other thing has to be performed.
