My brothers filed case in lower court civil suit injuction on the basis of false/fake affidavit and court passed status quo. Property inherited from parents and duly registered and mutation done on all legal heirs including me. Since already more than 3 years passed in court and my brothers are intentionally delaying the case. My advocate replies that it can take upto years before the court. Someone had advised me to go to High Court and make writ since the case filed by my brothers are on the basis of false/fake affidavit which I have never signed and moreover any property cannot be transferred on simple affidavits. Please advice me that when the case is pending in lower court does High Court have the power to writ the present case as my brothers are not presenting false documents but also misguiding the courts. Please advice.

There is a vacate plot approx. 200 sq. mtr. in our colony and as per Government authorities cite plans (MAP) this vacate plot is for purposed for park. In nineteen eighties on this vacate government land some shops are open few shops are in possession of localities people and few in possession of person having plot next to this vacate plot.
Is it possible that owner of next plot claim himself land lord of that vacate government plot and claiming rent from others under Delhi rent control Act.

a case filed by the op at state forum has been dismissed with cost of Rs.5000.00
subsequently,during the filing of rp at ncdrc,as per their directions,op deposited the cost of rs.5000.00 at the state forum.The national forum dismissed the rp without any cost.
a) is the complainant/petitioner at the district forum entitled to get this cost awarded by the state forum?
b) if entitled,how to get this payment from the state forum? what is the procedure?

Hi Experts,
Here is my story so far,
We are 2 sisters, myself and my mother.My father passed away last year. He had Fixed deposits of around 10 lacs in S.B.I, (Visakhapatnam) for which he has not provided any nominee. So on inquiring with the Manager, he asked to obtain the legal heir certificate. After 6 long months, I got certificate. Now the manager has asked to get an Indemnity bond of around 20-30 lacs and also asked for a disclaimer affidavit and also an affidavit from 2 independent person stating that they know our family from long and as per their knowledge we are the only heirs.
1) Myself and both my sisters has signed the disclaimer and given rights to our Mother to collect the amount.
2) Since we are lower middle class people and most of the persons known to our family are not that knowledgeable, getting surety was a big problem(they were all afraid), but we managed to get 2 surety. One of them own a registered apartment worth 11 lacs in 2010 and another surety who owns a house and living in it for past 15 years but it is not registered and only has a sale deed with them
So Experts can you please clarify on the following doubts,
1) Since we are already providing an affidavit from 2 independent persons stating that we are the only heirs, do we need a legal heir certificate again.
2) As we have both the legal heir certificate and disclaimer certificate, what is the need of surety?
3) and for 10 lac amount, what is the surety amount required?
Please advise me on this, as this process dragging since past 1 year and causing a lot of stress and pain to our family

Sir,
I attended at Passport Office on 30/7/13,it was renewal on expiry of old one. Physical Verification at Police Station was over on 12.8.13,I did not pay the bribe.The expectation was of Rs.1500 to 2000/- the passport application is at SP office now.
There was one false Criminal matter in 2007 where I was acquitted.I submitted Judgement/Order which was shown to the clerk,processing the file. Upon completion of Verification my photo was affixed in a register and my thumb impression and signature was taken thereon.
Now to day I visited the SP office to find the status still pending at Passport website. There I could see my file wherein I found the following,
1. The report is "ABSCONDING",when I myself in person appeared in the thana and completed the process.
2. The last 2 pages of the Judgement/Order produced were missing which showed my acquittal and discharge.
3. Today,I applied under RTI my file and contents of the same. The Circle Inspector who is Information Officer said he cannot give all those documents as they are secret. I have told him to give it writing.
These being facts,
Please guide what should I do next?
Especially on the remark "ABSCONDING" and missing pages of the judgement/order.
Please guide.I will be obliged.

recently govt has issued letter to D M for recovery of amount, stated in bond in between doctors and govt., as some doctors failed to complete service in govt. set up, as in mentioned in bond.
some of doctors have already passed the exams more than 15 yrs back and govt. is asking for recovery.
is thr any case law regarding limitation period for execution of bond?

yes ,either 5%every year or 15% in three years is permittssible increment in rent ,irrespective of agreement or no agreement

Two brother A & B having two plotes of joint ownership. They made a partion of two plots in form of taking one-one plot.after the partion B executed a registered release deed of his half share one plat in favoure of A but A does not executed any document.Now both A & B have expired. after the death now the heirs of A filed a suit for partion relating to the plot which came into share of B claiming equal right. Now my question is that at present when the Heirs of A has refused the partion than what will be the position of Releass deed executed by B.Can we challange that Release Deed in court if yes please tell the grounds also.

Possession of suit land during status quo
Dear Experts,
Partition suit is pending in High Court and Hon. Court has ordered a status quo on the land in question.
The consutruction work is going on in full fledge by various contractors/builders and occupying the space.
We don't have enough finance to file case against each for contempt of court.
Is there any way to complaint this police and take possession of vacant space before everything is occupied since we are declared party/legal heirs/shareholders.
