Evidence

In a case for recovery, the civil court passed the following order:
1. List of witnesses to be filed by both parties.

2. Put for plaintiff's evidence on 22/11/13

I am the plaintiff and I don't have any witness.
Do I have to file any evidence by way of affidavit on 22/11/13 or the documentary evidence filed by me in the plaint along with supporting affidavit would suffice. What exactly would take place on 22/11/13

Unknown charge in ancestral property

My father’s aunt ( my grand father’s sister )was getting her husband’s pension. She died without children on Oct 2010. No one has intimated to the concerned authorities so far till now. She had also created so many charges in the ancestral property in which she lived.
Now the decree- holders are coming one by one to us asking for the money.
1. What will happen to the pension? Where will it be accumulated ?
2. Do the decree holders have right to attach her pension, as she is no more ?
3. Is my father liable to the decree holders ? they are threatening us (we do not have any knlwledge about her borrowal to various persons )
Pls need answer with legal provisions in detail. Thanking u all in advance.

Chamber summons

I have to file a Chamber Summons in the Citi Civil Court in Mumbai, for changing the address of the Defendant in a Summary Suit. Earlier tried to serve the Writ of Summons through Bailiff but the Defendants have shifted their office. I have the following questions:

1. Since only address has to be changed, can I mention the same in the body of Chamber Summons or I have to annex the address separately.
2. I think first I have to move a precipe and submit to Court and take leave of the Court before Numbering by the office. Is this correct.
3. Can I serve the Writ of Summons duly changed the address alongwith the Chamber Summons on the Defendants at their new address.

Shall be grateful for the valuable guidance.

Thanks & Regards,
