My father vishwas met with an accident in Apr 2010.
My father was survived by his mother (chitra) second wife (suman) two sons suhas and vijay. (Suhas that's me) . My father had one son(satish) from first marriage and had performed second marriage without seeking divorse.
Suman and vijay lived in VAPI Gujarat . Chitra satish and myself living in satara district Maharashtra separately.
Father had two flats in VAPI Gujarat which were sold by mother without any consent from people in MH and gave entire money to vijay.
Father had rs 20 lac in F.D in one bank at VAPI. Suman and vijay together were nominee for 15 lac and I got 5lac.
In another bank rs 12 lac were in F.D of which I got 170000 as nominee and rest was equally divided between suman vijay and myself by making a legal heir certificate (names of chitra and satish were excluded from family tree) after getting money from this bank vijay betrayed me and did not share property money with me
At satara MH father has 30 lac in f.d at one bank father did not keep any nominee for that.
Chitra and satish have filed a civil case in satara court stating their claim in the money satish is afraid of going to VAPI Gujarat because of vijay contacts with police and judges.
Hence satish would be demanding a setoff from the court for his claim and of course for grandmother's share as well.
All of the above assets are fathers self earned. Late grandfather (anandrao)had 15 acres agri land in satara district.
Anandrao has 6 married daughters and three sons. My father was the eldest. In 7/12 my father has his name along with his two brothers. Sister have their names as itaradhikar.
The above story is complicated only a good expert can solve my queries.
1. What I should be doing with the only money left in satara bank.
2. Is there a problem for me as a nominee and for making a legal heir certificate (excluding chitra and satish)
3. Will satish be successful in claiming a setoff in MH without going to Gujarat.
4. How can I claim my share in VAPI property which suman sold without my knowledge.(m.v 20lac)
5. How can i claim my share of agri land in satara.
Please guide me through this

A case in Small Cause Court of Mumbai was decided against the defendant, Mr.A & B (trial court). Decree was passed to vacate the peaceful possession of suit premises i.e. 2 rooms on the mezzanine floor of the suite property and not to create third party interest. Appeal was filed by the original defendants and lost. A revision petition was filed by the original defendant/s in Mumbai High Court and lost again. An undertaking was given by original defendant/s in the High Court for not creating third party interest and giving peaceful possession of suit premises. The defendant/s were to vacate the suit premises by 31/10/2013. One of the defendant left the premises leaving behind her daughter (aged about 50) the adjacent passage of the mezzanine floor. Other defendant was evicted as per court order and possession taken by the landlord. Whether this amounts contempt of court on the part of one of the defendants and defendant's daughter can be evicted from the passage. If yes, then what needs to be done. Please advice

Hi,
One of our female employee cheated us to the tune of 3.25 lakhs. Police took six months to register FIR. Thereafter as nothing was happening from Police, under RTI act I asked for 'action taken report' on the case. The IO informed that the case is under investigation.
I wrote grievance cell of Goa who instructed DIG to take action on or before April 2013. As there was no action from DIG I wrote to the Home Minister of Goa complaining about no action being taken three months back. There is no reply from Home Minister nor any action is initiated by Police. How can I ensure further legal action on the said ex employee? Thanks
Res. Expert,
The case is,the owner of the property made a will to give rights to live in the property to his step wife till death , then property will go the his owner's son. But Owner's son has expired and step wife is alive. Son has made will in favour of his real sister as he was unmarried. is he is eligible for preparing will ?
Now, the daughters of owner's first wife has filed partition suit asking that as the son has expired before become property owner, the property is vested with all the heirs equally. Can they entitle ?
Now, what defense can be taken by step wife in the partition suit?
Clarification :- Owner is already expired before his son's death and secondly property was self earned by owner not hariditory.

In the matter of execution petition
A, who was serving as government employee under Punjab state government has passed away with 6 years length of service. B, wife of A filed civil suit for declaration against State of Punjab for pension and the same was decreed by civil judge junior division. Accountant General Punjab, who is competent to grant pension to government employees of Punjab State and who had not been joined as party in civil suit, denied the claim of decree holder on the ground that total length of service of A is less than 10 years and as per Punjab Civil Service Rules any government employee having service less than 10 years is not entitled to pension. Now B filed the execution petition and Hon'ble Court attached the property of Office of District Officer but the situation is that District Officer can not grant pension without approval of Accountant General Punjab but Accountant General Punjab is not bound to do so as he had not been joined as party in civil suit. My question is that legal maxim lex non cogit as impossibalia will apply here in this case ? What should District Officer do now at this stage??
