Land cheating

Sir.,

We (20members) have purchased a land each 300 sq. yards from landowner in year 2005 with the cost of Rs. 180000/- each( each square yard cost Rs. 600/-) but the registration cost is about Rs.60000/-.

After passing seven years i.e., in 2012 we noticed that the land owner is cheated by way selling this land 2nd time.

We requested him to pay the amount with Rs.2/- interest “ or” show to us equivalent value land, but he denied., and arguing go to court “or” police sation. He refused our plea and argued like this.,
if police arrests me I will come by bail with in few hours and court will take nearly 10 years time to settle the matter at that time I may not available to you (because his age nearly 70 Years).

1. In this situation what we wiil do?
2. Is it court will take 10 years time
to settle the matter?
3. How much compensation we will get?
4. At present the market value is Rs.
4500/= per sq. yard (1350000) and
registration value is about Rs. 1500/-
(450000/-)
5. Can we attach the properties of the
landlord till settle the matter. And he
is a very rich person and having lot
of assets?
6. where we can file the case actually
this case related to one of the
district in Warangal , Andhrapradesh.?
7. Simultaenously shall we file case in
police staion and court.
8. Individual filing of the case is better
or group?
9. Approximately how much expediture will
incure for the whole process.
10.If compensation is decided where we
will collect the compensation, because
landowner again threat to us, if we
ask comensation as per the court ruling.

Kindly guide me in this regard.

Thank you sir.,

Credit card - defaulter - time limitations

Sirs,

At present I am residing in Malaysia but I am a NRI. When I was in India in 2005 I got a call from an advocate saying he is talking in behalf of ABN Amro Bank and I did not pay my credit card dues from 2003 which was taken from ABN Amro. I informed that I had not taken any credit card from any bank I got continuous calls for 2-3 months after which it stopped.

In 2006 I came here to Malaysia and started by business after which there was no communication regarding this Credit Card Due. Recently in November 2013 I am getting calls in my Malaysian Number stating that ABN Amro Bank is taken over by Kotak Mahendra and there is an outstanding payment in my credit card from 2003.

I am really frustrated due to this daily phone calls.

1. I had not taken any credit card in my life from ABN Amro Bank.
2. Even if some one had used my identity and taken the credit card is there any time limit for claiming that money back ?
As they say its outstanding from 2003

Kindly help

Government acquired land

Law of limitation

A trust was created in 1901 where in settlor
prescribed in trust instrument full objectives of trust with full details for becoming trustees, functions etc. There was no
amendment clause in the trust instrument.

In year 1975 a supplementary trust deed was made without the consent of court, where by
50 percent objectives of trust was changed against the wishes of the settlor.

Again in year 2011 another supplementary deed of trust was made without the consent
of court, where by balance 50 percent objectives of trust was changed against the
wishes of the settlor.

Can both this supplementary trust deed be
challenged in Court, or limitation Act is
applicable.

Appeal against defreezing of account

My partner and I had a joint account which was freezed after a dispute. The matter is in court and the hearings are complete. I fear that the court may rule in my partner's favor and will like to appeal in higher court. But filing of appeal is likely to take few days and it is likely that my partner will withdraw the whole amount in the meantime. How should I prevent this?

Two wives: who will get pension.

My father is a Muslim and he is a government employee(state government of andhra pradesh) died leaving two wives and children.
First wife is legally wedded wife(Muslim)and she has a son(24 years)and daughter(23 years)and first wife is a nominee in all government records and Second wife(Muslim)and she has three daughters(4years, 6years and 8years.we think that she is illegal.officers said that i am eligible for compassionate appointment as i am the only son of first wife and second wife doesn't have any right to ask about the compassionate appointment.
My Question is who is eligible for family pension and why? and will the government(court) agree for two pension accounts separately for first and second wife(50% pension for first wife and 50% pension for second wife)and who is eligible for all death benefits? and under which act government will give two separate pension accounts for two wives?

Recently they lodged a case in Permanent Lok Adalat that she wants full pension or half pension in separate account and in death benefits she(second wife) wants 50% of share.SO JUDGE SAID THAT SECOND WIFE IS NOT ELIGIBLE FOR PENSION AND NOT SEPARATE PENSION ACCOUNT BECAUSE FIRST WIFE IS NOMINEE AS PER GOVERNMENT RECORDS AND SHE SAID TO FIRST WIFE TO GIVE ALL THE MONEY BECAUSE SECOND WIFE HAVING THREE CHILDREN AND THAT TOO FIRST WIFE WILL GET FULL PENSION AND HER SON WILL ALSO GET GOVERNMENT JOB TO GET MATTER SETTLED and first wife agreed to give full amount(gratuity, insurance e.t.c)
But second wife not agreed and her lawyer said that there is a act to give separate pension accounts and argued with first wife that you have to give half pension otherwise he will put a case in court.
WHAT WILL BE THE JUDGEMENT IF SECOND WIFE IS LEGAL OR ILLEGAL?(SHE DOESN'T HAVE ANY PROOFS)please help, Thankyou.
