Sir,
I would like to know that how to fix the seniority of government with details given below:
1. I am working in the central govt. since March 1996 as Technical Assistant as scheduled caste candidate.
2. I have got promotion on 18.12.2002.for the post of Sr. Technical Assistant
3. In the year 2006 there two posts was lying vacant for the post of Jr. Technical Officer which is under feeder cadre, one was reserved for scheduled caste candidate and likely to be filled through direct recruitment other was for general post and likely to be filled through promotion.
4. In the year 2009 there one post was lying vacant for the post of Jr. Technical Officer one was also reserved for scheduled caste candidate and likely to be filled through promotion.
5. In the year 2010 two posts was again lying vacant for the post of Jr. Technical Officer which is under feeder cadre, one was reserved for OBC candidate and other was for general post. Both the post is likely to be filled by direct recruitment.
6. In the year 2011 there one post was again lying vacant for the post of Jr. Technical Officer for general candidate under promotion.
7. In the year 2010 one post was filled which is for general candidate of 2006 and reserved vacancy was not filled due to malafied intention and an office order was issued and the reserved vacancy was filled after revival.
8. JTO vacancy of 2009 was also not filled due to malafied intention and this vacancy along with vacancy of 2011 was filled after the direction given by the ALLAHABAD CAT
9. Two vacancies of JTO of 2010 were advertised from UPSC in the Jan 2012 and one vacancy of general candidate was filled July2012and vacancy of OBC was NFS at UPSC level.
10. After all mentioned above story I have challenge in ALLAHABAD CAT to fill the vacancy of 2006 in Nov.2012. I have granted stay order to fill the vacancy of 2006 first, till then UPSC recommended candidate shall not give effect. Stay order was vacated by the department on Aug.2013 and recommended candidate has join on Sept.2013
11. After the service the stay order department has taken action and the vacancy of 2006 was advertised from UPSC on 27.08.2013 and I have selected for the post of JTO through UPSC.
Now I would like to know from all of you, how to fix my seniority, my case is still pending. If the department is not able to fix my seniority then can I challenged to fix my seniority. Is there any ruling with to fix the seniority of such a peculiar case?
Yours truly

We bought a second hand Accent from JMD Motors in Gurgaon for Rs 125000/- and paid 20,000 for some repairs, RC and insurance. Since the day we bought the car we have been facing problems every other day with it and getting it repaired. We have spent around a lakh after we purchased the car and still the engine and suspension work is required to be done. We have bought a car and not heap that we have to get each and every part of the car repaired every second day. As a dealer his responsibility doesn’t get off just by selling and delivering the car. It was his duty to check it thoroughly before selling at the first place or atleast would have told us about the exact siyuation of the product, but since he hasn’t done so he should now atleast take the responsibility to get our hard earned money back from the owner who cheated on us by selling crap.Further, its been more than 2 months since we purchased the car and we haven’t received the RC yet for which we will have to pay Challan if caught by the Traffic police.
Kindly guide, if anything can be done about it if a complaint is filed in a consumer court. We want our money back. and also let me know how can I send a legal notice if I want to defend my case myself without hiring a lawyer.

My ward studies at a CBSE affiliated pvt school run by an education foundation. The school charges fee on quarterly basis in advance at the start of the quarter and charges late fee @ rs.10 per day after 10th day of 1st month of quarter.
As per Delhi High Court order dated 10th April 2013,
"parents cannot be forced to deposit the school fees on a quarterly, half-yearly or yearly basis."
My query is
1. " Can this Delhi HC judgement be enforced on schools operating in Ghaziabad, U.P.???"
2. If not, what is the way out for parents seeking relief on the same grounds as petitioners of similar case filed at Delhi HC on which the above judgement is passed???

In our society the managing committee resigned in between their term in 2013. Thereafter the ex-office bearers circulated a nomination form asking members to elect new managing committee. This was in a General body meeting counted and whoever got majority nominations were declared as managing committee members. Is this a correct way of holding elections. Our society has just 35 members. Please help.

Dear Friends
This is very important
My client has been cheated by a real estate company and now they owe him a large sum of money. However, before giving his payment, they are asking him to sign an undertaking that he has received full and final settlement and that he wouldn’t sue them in court.
At this stage, he don’t have any option but to sign the undertaking. But after receiving his payment, can he go to the consumer court and claim the damages and remaining payment.
Will the court accept his plea though he has signed the full settlement undertaking.
Pl advise?

Hdfc personal loan defaulter
I had taken loan of amount of RS-135000 from HDFC Bank on January 2012 for 3 years. I am currently working as Software Engineer in pune.
My salary is RS-23,000PM
I was unable to pay my 5 emi's of RS-4915. Due to some personal reasons i cannot able to save money from my salary to pay my emi.
I have paid 7 emi's from the date i took the loan but all the emi's paid are after the due dates.
Now, i have received a legal demand notice from a bank lawyer.
It is written in the notice that i am included in a proceeding under section 138 of NIA and also proceeding u/s. 420 of IPC.
I read about section 138 of NIA and it is applied to me because of bounced cheques.
Although i paid 7 emi's not on time but
I will pay all emi's to the bank with interest charges(added for not paying on time).
It is written in the notice that i have to pay the amount within 15 days.
Now, i have few questions:
1. I cannot pay the said amount within 15 days but i can pay it in 25 days. According to notice, will the bank take further strict civil and criminal action.
2. Will such civil actions against me spoil my career.
3. If within 3 years duration of my personal loan, if i am again unable to pay emi for 5 months then in that case, will i again become convicted as i received one 138 NIA legal notice previously.
Please help me in this regard, i am really worried.
