Sir,
Our old house stands in the name of grandfather who expired in 1999. I have two uncle i.e. my grandfayher has three sons as his legal heirs. My father along with his family i.e.myself and my mother came to stay in above house and said house is in our possession since last 50 years without any dispute or objection. But the property card, electricity bills and other legal documents are still in the my of grndfather. We have address and other proof showing the said house is in our possession since last 30-40 years. My father expired in 2008. but till date no legal heirs have come forward to claim the property. If we go to them for NOC, they will not respond as our relations are not that good.
Sir my question is can we apply, being the legal heirs,in the court for ownership of house under adverse possession act or is there any other way to get the legal ownership. Please guide. We stay in Pune.

There is a person who making forgery to aquire the land of my family. With the manipulation of land records. And claiming that he is our family memeber. on the just a similarity in name of my mother and his mother. Again under RTI i collected all the evidence about him and his mother such as proof of name, address and voter list also. To proof that he is belonging to some other family but just to misuse the similarity of name of his mother.
On the other hand he passes ex-party court order by sending a sumons on the false address. we applied to honorable court regarding con-donation of delay. which is accepted by the honorable court. With the help of ex-party court order he tries to sale the land again he manipulates the land record. On the other hand he mislead the court of law.
He should be punish for the forgery, fraud, and misguidance to court of law.
Now he is harrassing us saying that i will sale the land and he threaten us to kill us. Please help in this regards.
And guide to get the solution on this problem.
Following is the flow of case till today
1)I already got and stay on the ex-party order.
2)Summons send to other party two times
3)Summons not delivered to him
4)As per court instruction same summons is publish in local news paper.
5)After that court given 15 days time to other party to appear in court.

I have a lawyer but i stay in mumbai and this case in aurangabad. i cann't aford a lawyer from mumbai to work on case in aurangabad. so i appoint a local lawyer but he is not giving me a valid reason for delay of the process.
Again If i ask more question about my case most of the time he says that it is legal process,This is a third lawyer which i have change for same case.last two lawyer have misguide me in this case.
Though he has not file application for stay in this regards.I face lot of problem in this case.
On the other hand if i want to make complaint about the last two lawyer how i go about it.
Even they charged me around 80000/-till last lawyer appointed.
1)In case of misguide of client by advocate can i demand refund of fees which i paid.
2)Can i request to any authority to take action against them
3)At least this would benefit to other victims like me.
Kindly Reply.

Case is like this.
My grandfather has three sons and my grandfather passed away before 10 years. All property records are on my grandfather‘s name. There is no official divided among these three sons but they are manually enjoying the property. Now my uncle (my father’s younger brother) builds a building on a plot which is more than his share forcefully by showing deadly weapons. So I put civil suit on the plot in our District Court, after that he also continue built building on that plot by violating Court’s stay order.
I want to demolition that part which stands on my father’s share. Is it Possible to demolition? If Yes the how , if no then how I got our share on that plot . Please suggest me what should I do .

Hello Advocates,
I am a IT professional and I am working in Bangalore, I have a issue with my home constructed by my dad. On 02.02.2011 my mom was cheated by some local culprits and took sign on our home sale deed, my mom was told that as my father is dead the property has to be transferred to her name and has took her to sub registrar and took sign on sale deed my mom is less educated and she don’t know all this registration work and believed them and signed where they told. I was away from home on a business and we came to know about this when that guy came to home saying this is my home and your mom has sold me. My mom also got to know on that day that they have cheated. We gave complaint to the police and police dint react much and they told you have to settle this I the court and backed out from the case. My Father has written a will that after his death the property should be under our uncle and he cannot sell or lease it and we can be in the home under his supervision. After his death the property will come to me and my mother right. So we filed a case in local court in 2011 and the hearing was going on and our lawyer was telling that the will is enough to get our property back and the case will be in favour of us. But a week back we came to know that the case is disposed as our lawyer has not attended the case and he has not at all submitted the will and we also came to know that he has collaborated with the opposition party and cheated us and he has destroyed the original will given to him. Now we have contacted one more lawyer who is very well known to our family and he himself has made the will for my dad. He says not to worry we can appeal in the court and we can present the will and we can fight in the court. But all our family members are worried a lot. We don’t have any place to leave then that home what if they come and push us from the home. I am not in India currently I am worried what will happen to my family out there. Our lawyer tells not to worry but how can I be without worrying. My worry is if our previous lawyer has not submitted the will till now will court accepts the will if we present now. And how strong the certified will can be used to get our property back.
Any suggestions will be helpful to relieve my worries .
Thank you,
Lohith

Hi, We are staying in Jaipur. There was vacant land adjacent to my house. Few weeks back, owner of vacant land has started business activity of iron bars (Sariya) in the vacant area. its a gowdam of sariya [ tmt bars ].The noise created by loading and unloading of heavy iron bars during day as well as night hours is very disturbing and irritating. The family members are complaining of headache and elderly people are not able to take any rest during day. The noise is not subsidizing even after closing Windows. Whom we can approach and what can be done in this case? Is such a disturbing and noisy activity allowed in a residential area? The ruling authorities of my city are Jaipur Development Authority, and Nagar Nigam. Please let us know how we can approach this issue. Thank you for your help.
he is very approachable person and said us "do whaterver u want, i'll not stop this"
kindly help me
Can a registered AGPA holder sell a property
Can a registered AGPA holder sell a property with out the signature of the original owner, because some one said that there are some supreme court citations which are saying that the original owner has to sign the sale deed even if the AGPA is registered. So please advise about this.
