Writ in escheat rajasthan -

Sir,
District collector has rejected the escheat proceeding on ground that -
1. Although the original owner has died in 1998 and a notarised POA was given in favour of "A" before 2 months of his death.
2. "A" executed the POA by Selling the property in 2017 to "B". so the district collector has no power to cancel the Sale deed registration. The matter is not fit to proceed under escheat.

I also registered the complaint under IPC 467, 120b, 471, 474, 34 etc and FIR also registered in 2018.

How to file a writ in Rajasthan High court and what points should be in writ.

Delay in civil case

As false and fictions civil case has been filed by out apartment owners on us...it was partially completed in 2011 and given position till date it has not been completed its on small site of 3000 sq ft and with 12 residential units. Till date the apartment is not registered..though we have all documents to prove our stand... And possession etc ...recently the judge of the hearing court was transferred....now the new judge is giving very long dates ...5 months after that 3 months so on...the case was filed in 2015. Can I approach HC by filling writ for speedy justice...pls advice.

Original plot papers lost

Hi team, need your suggestion to solve one of my friends problem. My friends father mortgaged his own plots original documents long back from a person whom we do not know. Suddenly he expired. He did not write any will on his children name. Is there any possibility to get cc copy? Will that be valid to sell the property. Pls suggest how to proceed

land dislute and priority

i want to know what is the priority of land over sale deed agreement and registered sale deed. is it possible high court cancle the sale deed becouse of land is under mortrage. but suit filed after registred sale deed

2nd transfer app 24 cpc in hc when first cta rejected allwd?

Respected sir
Wife again file 2nd transfer application to transfer divorce case pending in barmer to family court Jodhpur. Rajasthan High Court has raised that this 2nd appl is not maintanable u/s 11 CPC as "Resjudicata".
Wife's first appl was rejected in 2015 and now she again filed in 2018.
Next hearing is on 09/01/18.
Kindly suggest any ruiling on this issue to reject the transfer and speedy trial direction please.

Cross examination

Suit for partition pending in court and at the stage of plaintiff evidence for cross as in previous date plaintiff was crossed partly. Now the plaintiff have to move urgently else where and cannot attend the case for remaining cross on next date. Please suggest solution if someone else can attend on plaintiff behalf.

Zamindari return

Can any one tell me what is the Evidenciary Value of Zamindari Return filed by zamindars during Zamindari Abolition in India may be during 1950's in Bihar as well as in other States. Can a Zamindari Return filed by Zamindars be considered as a Conclusive Proof of 'Title' or 'Possession' whatsoever or whether it can be considered as Non Judicial Admission at the most. Is there any Case Law / Rulings / Judgements concerning Zamindari Returns . Plz Help me as it is my personal case.

The gist of the query is that whether the Zamindari Return filed by Zamindars is Conclusive Proof of Title / Possession or whether any Certificate of Return or any Corroborative Evidence is required to proove the correctness of contents of Return .

Interest on e.d.c.

I purchased residential plot at Panipat from Ansal. Before get the plot retested in my name about 5 years back ansal demand E.D.C. interest on that plot. I deposit the E.D.C. interest under protest to Ansal. About one month back I come to know that Ansal defeat the cases at local consumer court and state tribunal where ansal file a appeal.

Both the courts order to refund the E.D.C. interest illegally charged by ansal with interest.

I met my advocate at Panipat but he told me that your case for claim refund of illegally interest on E.D.C. barred by limitations. You can only file criminal complaint against Ansal. He also said that I only claim my refund within 2 years from consumer court and within 3 years from civil court.

Kindly suggest the better way way so that I am able to take refund of illegally charged refund.
