Dear Sir/Madam,
Hope you are all doing fine. Registered Will of my father is getting probated in the high court of kolkata. However my elder brother is challenging the will. His grounds for challenging with evidence would be he managing the commercial property for the last 12 years of which he was a partner with father in a 50% profit ratio previously a proprietorship firm in the name of my father. Business for the last 12 years has been just rental income. Will such ground stand before the judge to dispose off the registered will. He is also in the view that this suit can be dragged so that the probate can be delayed or disposed off after a minimum period of 10 years. Is that possible kindly suggest. Your expert comments really works.

Sir, i purchased a shop in the name of my wife and one land, on which 4 floors were constructed, jointly in my and wife's name.
Now because of estranged relationship , i have filed a divorce case and she has filed suit for possession and permanent injunction for the shop in which she is the exclusive owner though she didn't pay a single penny in purchase. How to save my properties?

Dear Experts,
I have filed a Civil case in District court and the case is pending from Nov'2015 for want of defendant's address, as she had let out her residense{ 4 portions } and staying in USA and not giving her address of USA as a result i am unable to sereve NOTICE to her; when she talked to me on phone from USA i explined to her the situation and she bluntly says in an arrogant manner; " Do whatever you wants to do".
The case is she had contructed a house{ above said residence} in my land, this came to my notice during the year 2012, while suryeing our open land adjacent to her residence.
Please advice.

As per my last query full details are as follows
Partnership firm is register with rigistrar of firms , but 2 partner retired and it was not register with registrar of firm , but in recorde of books of account it is settled with retiring partner. After retirement firm was facing difficulty with their business so they included new partner with all permission in 2014 . And terms and condition was drawn in reconstituion of partnership deed in 2014 before notary public .now they want to register pls guide me.

Defendants in their reply have annexed documents which they submitted to court and I require to obtain the copies of same which I was denied by copying agency that photocopy documents are not provided. To obtain the documents from defendants how I can request the court.

I am the owner of one of total three plots having a common passage and main gate for entry and exit. I have built a 2 storey building for residential purpose on my plot. Now one of the owner of rest two plots is planning to use his empty plot as a commercial garage. All the vehicles those would come and leave the garage after repairing will use the common passage which has a combined ownership. Is it legal to use the common passage for commercial purpose like this? What leagal action i should take to stop this? Please guide me

Sir, I had applied for Probate of Will of my father which was contested and allowed. I was told that within 3 months of judgement I have to pay court fees to obtain Probate certificate. If I pay court fees within 3 months and opponent files for appeal at higher court will my court fees money go waste? Will there be any problem to obtain probate certificate if I pay court fees after 3 months of judgement?

Extension of lease
Took a plot on sub-lease(registered) in 1985 for 35 years, ending in 2020 with a clear clause of further extension of another 10 years.The Sub-Lessor had also a registered lease in his name till 2020 with extension clause of another 10 years upto 2030, but I do not know whether he has obtained/granted extension for anothet 10 years ,upto 2030 by his Landlord. In my Registerd sub-lease deed there is no mention about subject to clause towards his obtaing/being granted extension by his land lord.Only sub-lease for 35 years and further extension of 10 years upto 2030 is mentioned.My Sub-Lessor do not come forward with any clear cut answer. My Query:
01 What should I do now to ask/seek another extension of 10 years from 2020 till 2030 now?
02 Can I apply to my land lord now for extension or can I only ask him for such extension in 2020 only?
03.Can my landlord deny me another extension for 10 years till 2030 saying that he has not been granted extension by his original landlord(if the case such be)?
There is no default in any manner by my side....
