Judicial Proceedings

Plaintiff filed suit for injunction against defendants. The father of plaintiff alienated the lands 30 years back and also deposed in one suit that he alienated the lands to others along with defendants. Now the case is the plaintiff filed the suit for injunction on the lands which were alienated by the father of plaintiff long back. Please give a judgment of supreme court or any high court regarding the witness deposed before judicial proceedings can be taken into consideration and it can be presumed.

Change of name.

Dear Mr Makkad Thanks for your reply and help but i want to make sure.
Are you saying that there is no legal law in what society people are telling us which is all story cooked up they are just doing what they want or what my uncle would have told them to say.So is it that my society people are fooling us by telling us that they have done according to co-operative housing society law.
Please tell me how to proceed for the legal action.

boundary wall

Sir,
Is it necessary to enclose the urban land under municipal limits with boundary wall? Is boundary wall a proof of possession? What if boundary wall removed by neighbor, in absence of the owner of the land some year back and owner did not reported anywhere?

Name change in the Cooperative society

Mr Makkad thanks once again but if you can tell me exactly what i have to do and what is the procedure. Let me tell u frankly i dont want o give my uncle a single penny from this as he has been cheating the whole family from so long when we were very small.As we never Knew what was happening between them.So please help me as because of all this my mothers health is affected and we all sacred everyday what will happen.

Additional Civil Judge Senior Division

Dear Ld Friend,

I have found that in the District Court the
Additional Civil Judge Senior Division and the Additional Chief Judicial Magistrate both in short write as ACJM while the meaning of ACJM fit for Additional Chief Judicial Magistrate and not fit for Additional Civil Judge Senior Division.

In terms of powers both are different one have civil power and the other one is of criminal power. SO how can we sue one name ACJM for judge and magistrate.

What is the real mean of using one name for both the categories ?

EVALUATING RELEASE/RELINQUISHMENT DEED

Can a lady who owns self aquired immovable property independently relinquish the whole property by way of a registered DEED OF RELEASE/RELINQUISHMENT to her son instead of a GIFT DEED / SALE DEED just to avoid the burden of STAMP DUTY and REGISTRATION FEES as all states do not have any special nominal stamp duty and registration like karnataka for gifts within the family to aviod future family disputes? Is it techinally allowed inthe sub registrar office? Does it carry the same weightage as a gift/sale Deed ?. IF NO THEN what is the other alter native to avoid stamp duty etc other then the future planning through will ? THANKS

2nd appeal

sir, we got a degree in lower court Midnapur.But the Other side went to H.C calcutta and appealed for stay.We hired the advocate but the advocate did not attended the case as he was purchased by O.S.In between i was busy as my husband and father was both in ICU ward,The case was orderd in degree of other side,We appealed for 2nd appeal since 2006 but till now the case in H.C is not be heard,For that we filed one more case to bring the previous case in hearing list but we are being lingered becos O.S advocate is not attending ,So what should we do to get relieve and bring 2nd appeal in hearing list as soon as possible thanks

Change of name.

Dear Sir,
What answer i got from u is satisfactory till i dont sell the flat.After my grandmother death the name was easily got tansfer to my both aunts name and nominations to my uncle he beign elder.When my aunt died the society office said the second owner becomes the first and the first nominee becomes the share holder.but till my aunt was there alive she tried to change the name but she was asked to get NOC from my uncle that is her brother then only they can do it.
I just want to know is the Society people are beign bias to him or really there is some law which is abiding the society from doing this.
We have paying from so many years thae maintainence and any other tax which is paid to the society.As i want to give them letter for changing the name can u tell me the wordings as what exactly to be mentioned.
Can i deduct the money from his share if i am giving him which i have been spending all the years on maintenance/electricity/Yearly painting/Yearly leakage maintenence.
If i want sell the flat can i sell.
