6. Classes of Criminal Courts.

Besides the High Courts and the courts constituted under any law, other than this Code, there shall be, in every State, the following classes of Criminal Courts, namely.

(i) Courts of Session;

(ii) Judicial Magistrate of the first class and, in any Metropolitan area, Metropolitan Magistrate;

(iii) Judicial Magistrate of the second class; and

(iv) Executive Magistrate.

Query : Which court can a person can appeal first & than where to appeal & go on till the high court. (In Short Which one is the first court to appeal & if the order are not proper than where to appeal & if that order is not proper than whhere to appeal).

There pecuniary jurisdiction & jail term they can answer whether 1 or 2 years.


Also tell me the book to get more detail about the types of magistarte there powers & court & there powers.

Recovery of monies from foreign company


What procedures to be adopted legally to recover the money paid in advance by T/T to a company, which after receiving the money, failed to ship the materials contrary to its delivery commitment and cut off the total communications ( i.e. tel./fax/ e-mails etc.,) deliberately.

PLS IT IS A REQUEST TO EXPLAIN ME THE MEANING & DIFFERENCE BETWEEN THEM ALSO THE POWERS THEY HAVE & WHICH CASES ARE APPEAL IN FRONT OF THEM WHICH CASES THEY CAN TAKE WHICH THEY CAN'T ALSO IF THE CONTEMPT OF CONSIDERING THE OTHER MAGISTRATE ORDER WHERE TO APPEAL. what is diff. between the powers of judicial magistrate and executive magistrate ? If possible with the help of a example.

So what are the Difference betweenn First class magisrtate & seond class & judicial magistrate and executive magistrate. they powers. What are the cases they can hear in a appeal. Also what qualifications required to become a above four magistrate. In short full detail of magistrate of all the class & they powers. pls Pls Pls Psl Pls.

jurisdication of lower courts

When a case is pending in the high court can the defendant go to lower court and ask for an injection or status qo.

Instigating & aiding to file false complaint

What would be the punishment under CPC when a person, who indulges in instigating and aiding to other(s) to file a false/frivolous complaint against particular person to score of his old vengence and tarnish image of that particular person?

Will you plese give a recent case on this suject?

Tennancy

A Muslim partition suit, with 11 members 6 sons and 5 daughters was decree in the year 1954 with each son entitled for 2/17th share and each daughter entitled for 1/17th share as per Mohammedan law in all the suit schedule properties. The case is still pending in Final decree proceedings.

One of decree holders Son had lease one of the suit schedule property to a farmer in the year 1956 after Decree, As tenancy act came in 1974, the farmer claimed to be tenant
even though all the decree holders had not let the land for lease somehow he managed to become a tenant.

Question:

1) The case is still pending in final decree proceedings, now this farmer has filed an application in order 21 rule 97 to delete the items of decree schedule property for which he is claiming tenancy. even though not all decree holders had lease the land to him.

2)Is the farmers tenancy claim is valid, because the suit is pending from 1948 and it was decree in 1954 and tenancy happened in 1974. Only one of the decree holders sons has let the land for lease to him not all decree holders ?

High Court Larger Bench.

Single bench decision of the HC of the same state has got binding effect than larger bench decision of HC of different state.(meaning of larger bench decision ) Also pls comments on the above mentioned topic if possible with the section s& case laws.
