Public Trust in Mumbai

Public Trust covered under Bombay Public Trust Act 1950.
Trust Rule requires that 4 Trustees be elected by direct elections by the members.Maximum term is for 3 years or till pne resigns or paases away.
3 trustees have reisgned but instead of having elections the fourth Trustee has co-opted members who do not have the trust or the confidence of a majority of the members.
Accounts presented for 2008/9 too are filled with errors so members have refused to approve them without full details being provided.
Trustee now says that even though his term is over he will not call for elections till 2008/9 and 2009/10 accounts are passed as presented by the Auditor without questions.
What does one do legally now.

Signatories to a Public Trust Bank Account

A Public Trust approved Rule states that the signature of the Hon Treasurer is compulsory and that of the Hon Secretary is the scond signatory to all Trust cheques.
But the President got himself and one more Trustee as alternative signatories.
We are told that bypassing both the Treasurer & the Seceatary the President and the other Trustee have been issuing cheques, enashing cheques in bearer form
(cash across the counter).
We spoke to a bank official who has said that the bank is only concerned with the operating mandate filed and not the Trust rules.

What do the members do when they know (but cannot get proof) of this siphoning out of funds.
Trust banks with a co-operative bank and they say they not covered by the RTI Act in Maharashtra.

can a common judgment be challenged by each petitioner seperately, before supreme court?

Sell Property

Husband and Wife purchased a flat jointly . There is no demarcation of share of each spouse. i.e. share of each is not mentioned in the sale deed.
Husband died leaving the wife and a minor daughter.
whether the daughter has any interest in the flat? what is the share if yes?
Whether the wife can sell the flat ignoring the daughter?
What the wife should do if she wishes to sell the property?
Daughter still minor.

Accident case with LLR License

"X" is rider of the vehicle and having valid effective LLR License. "Y" is pillion driver and having valid effective Driving License. "Z" is Pedestrian.

"X" hit to "Z". "Z" got injuries and filed a case u/s 338 of I.P.C. and Motor vehicle act, claiming compensation.

My quarries are

1. "X" want to show liability on Insurance company only to pay compensation to "Z".

2. "X" is poor person, hence "X" want to escape from liability.

3. Please provide any citation or section of law to show liability on Insurance Co only.

Encroachment Removal


Sir,
For removal of encroachment done by the neighbor, when owner of the land was outside, which legal remedy is best?
How much time it will Take? And what will be modus operandi or how will be encroachment get removed if I win the suit?
