1. Whether the registered firm can sue the notice as its own (firm) name with out representation of partners (or) Authorized person ?
2. whether firm can sue any proceedings without representation of natural person ?
any one have the apex court judgement in this regard kindly provide

Hi,
I am Rajiv Sargar and I was working with the IT company Cognizant.
They forced me to leave the company with out prior intimation. And meanwhile when I was working with the company.
I was not given chance to work well. And all the time mentally harassing me also there were events happened which caused me physical harm also.
Multiple attempts to catch me in some sort of conspiracy. And making me feel that I am of no use kind of behavior with me in the company since I was hired. also trying to program me for some false doings. So that I can be victimized on that Everytime.
And there were some physical injury attempts. Also keeping me hostile in the work place so that I can not perform good. All the people around me even my teammates and coaches were programmed to make things worse for me.
Letting me know that you are not going to do anything without some vague permissions.
Managers never had a word with me on a good note. Always telling me that you will be fired. For what reason I don't know. Also embarrassing me in front of everyone all the time.
And after all the harassment and bullying and torture. These guys wanted me to leave the company on a good note.
Where these guys forced me to get off the company without giving me chance to show the data I have worked during my tenure.
Also pressurizing me to resign from the company.
When discussed with the managers no response also from HR.
And the relationship hr manager is not responding to the phone calls.
After all this keeping an eye on my online activities and sending random notifications all the time. Suggesting stupid things on internet using every single platform. Like Youtube, fb and on emails.
Also building a pool of people around me to monitor me online and offline. Trying to catch me in any kind of misconduct that can be anything.
So this seems unbearable and not acceptable way of telling someone that you have to move out. And u have no rights for making any decisions in ur life.
Hence I would need assistance so that the legal action can be taken on the same.
I have screenshots for all the notifications which are related to me offline or online activities.
Also I have a proof for the physical harm done when I was on bike. Thanks in advance.

Dear Sir,
i am working in a PSU and my current PSU HR manual says that i have to apply for NOC during the time of Application for separation for outside employment.
I have applied in another PSu without intimating my current employer which is a PSU too as i thought i will apply for the same during interview after clearing interview.
Now, when i have applied for NOC they are denying me from giving NOC.
Some people are suggesting you attend the interview and give undertaking that you will not ask for transfer benefits,Gratuity,leaves to be transfeered and will join after resigning,
Pls guide me appropraitely to how to proceed?

I have been dismissed wrongly n also mentally harassed during my tenure with the company.
Some physical harm also done indirectly to me. Hence need help on d same.

I along with my two brothers stay in a flat measuring 3630 sft with three car parkings.We three brothers have purchased vide three separtae conveyance deeds for 1210 sft each with one car parkings.The flat is thus owned by three brothers but it is one flat.The conveyance deeds are under collateral with a Bank towards credit facility obtained by our sister"s family.The account has become NPA and we are facing bank"s action for taking possession our flat.we have executed separte loan agreements and have guaranteed upto the value of the flat only and no personal or other guarntee.Though our relative have been assuring us of getting them discharged but it is not happening and we have lost our peace.There is also differnce of opinions among three brothers about seeking release og the property by settling with the bank indepandtly.But I am not able to survive the day to day problem and our all other activities are getting affected.Can I separately approach the Bank for settling for my separate Conveyance Deed independtly and shall the Bank will be ready for that ?My other two brother do not object my personal action for my conveyance deed.I can not have any kind of tussel with my sister"s family as they are themselves is in trouble for genuine reason.what should I do ?

Me from mumbai, working in a private limited company in pune,joined in july month as mis executive.As per company rules I should get my key responsibility area(KRA) and standard operating procedures material(SOPM). Sopm I got in august but kra still I not received till now. Due to which seniors keep giving me any work.
Early they told my work is filing then sometimes I hAve to do gre admin work now when the deadline given by MD for completion of file. They r telling my work is only doing entry in system.
And both lady boss n gentleman boss keeps telling me that I am extra cost for company.
Now lady body started using me inside the keeping despite of doing proper work, this told me that I sent mail putting cc to her boss.
Is it so that this mental harassment will keep going that they can speak to me in any language just because it is verbal n inside cAbin it is happening ?

I am member of this club. As per my knowledge the Co.Op. Chs is not supposed to collect Service Tax from members thru Maintenances Bill..
Buylawas does not provide this recovery and therefore it is illegal to revover this tax from members every month.
In our society secretary is planning to recover this tax thru maintenance bill .
In view of the above I wanted to have your opinion on the Issue of SERVICE Tax collection. kindly let me know , whether it is legal to make such recovery from members every month.

Dear Sir/Madam,
I am looking at an individual row house in which to start a salon in a Mumbai suburb.
The owner is agreeing to helping with procuring shop and establishment and health licences from the Municipal Corporation of Mumbai.
However, he is not agreeing to do a change of user from residential to commercial property type.
Moreover, he says that if the salon is on a 30 foot wide road, has an independent entrance, a change of user to commercial is not needed to operate a salon.
Please advise if the shop and establishment, and health licenses will be sufficient to legally operate a salon business. That is, it is legally acceptable and a change of user to commercial property is not necessary in this case if the said licenses are procured.

We have a partnership firm which is having a registered partnership deed since 1982. The partnership deed simply metions that profit/losses will be shared equally between the partners and partnership is at will. My father who is a partner in the firm with my uncle is now old and week and unable to work due to his health issues. Due to this, My father submitted his reignation from partnership to my uncle last month. Following that an agreement was signed between my uncle and my father on a RS 100 stamp paper with a witness (but it was not notarized). The agreement mentioned that "Mr. X (My father) due to his health related issues has expressed his desire to retire from the partnership firm on 1 st Oct 2016 and both the partners have agreed to dissolve the partnership on 31st October 2016". Also another point in the agreement was mentioned that
A) "After dissolution of firm the property of the firm which is registered in firms name now will be divided between the two partners as per the map attached with the agreement"
B) The loans of the firm will be divided equally between both partners.
And The agreement was signed by both partners.
Now my query is:
1) Now my father is on bed due to his bad health and I have asked my uncle to come to sub-registrar office(Tehsildar) and I will take my father with me so that as per agreement we sign a dissolution deed there and dissolve the firm and divide its property as per the agreement. But my uncle is refusing me to accompany us and sign the dissolution deed in the registrar office. How can I dissolve the firm now as per the agreement? Because I guess based on agreement only sub registrar will not transfer the property of the firm in my fathers name, they need a registered deed.
2) Since this is a two partner firm and in the agreement it was mentioned that both partners have agreed to dissolve the firm from 31st october 2016 so if i am not wrong the partnership as well as the partnership firm is also dissolved by that agreement. My uncle says that he will also not work as properieter after the firm is dissolved but is continously doing the manufacturing operations in the firm after 31st October and also taking goods from suppliers in firms name. What should I do to evacuate my father officialy from this partnership firm and also get the part of the property agreed in the agreement? I am also ready to pay the loans and liabilities of the firm.

Dear Sir,
We had started business with four partners with name of Firm M/s Bajrang Minerals producing Manganese oxide but it was mishandled by partner and now business is in loss, But partner did not want to sell it ,
There is 50 % share with spouse of each , land is the name of my wife , mortgaged property is mine , I want to separate from the firm by selling my share.
As Partner is not ready to compromise at all so I want to sui legal case for the same.
Can I start in following ways:
1. Stay on production activities which is being handled without my consultation .
2. Can I sell my share individually without agreeing by him.
what step should I take
