Non payment to small scale industries

Dear Friends,

We are small scale industries registered with NSIC.

We had supplied material to a Pvt Ltd company. Payment terms were 30 days from the date of receipt of goods.

But now that company is not making payment. We have made several reminders but they are not responding.

Its been more than 90 days payment become overdue.

Please suggest the remedies available with us to recover the payment under MICRO SMALL AND MEDIUM ENTERPRISES DEVELOPMENT (MSMED) ACT,2006.

Also please suggest the time that will be taken by court to determine the matter.

Arbitration

Can somebody oblige me by providing latest/old judgement of Supreme Court/High Court(s) relating to Section 11(5) of the Arbitration and Concilliation Act, 1996? I have already tried on India Kanoon search engine but have not been able to find any one relevant to my problem.

Mortgage property without the moneylender license

my friend has mortgaged a property with a moneylender having firm named shanthilal & co.
but @ the time of mortgage the agreement is done in between names as shanthilal jain & raghu in the simple mortgage deed..
1-WANT 2 KNOW THE LEGALITY OF THE DOCUMENT AS THE MONEYLENDER HOLDS THE LICENSE in name of shanthilal & co .
2-can my friend claim that the license is not there on his name as the license is in name of shanthilal & co??
3-can this mortgage b null & void?????

Promissory note

) I want to lend some amount to my friend.planning to take a promissory note from him.please guide me what precautions i need to take?i am also collecting 3 blank cheques on behalf of payment given.should i type the ondemand & cosideration receipt or just fill with a ink pen?

2) At the time of maintaince judgement, Is this promissory note will consider by judge? Please advice.

Purchase against form h for sale to sez

Hello. I am a trader of textile products. I am based in Coimbatore, Tamil Nadu and i want to sell to an Sez Unit in Andhra. I intend on buying the goods from a manufacturer in Tamil Nadu and selling to the Sez Unit in Andhra. Please inform if i can purchase the goods from manufacturer against form H. If yes, in course of export we submit a B/L to the manufacturer, but in this case as there will not be a B/L what documents should i submit.

Are students a consumer under consumer protection act 1986

I want to sue my university in Consumer Forum for wrongly posting my marks in mark sheet as seventeen instead of seventy (as written in my answer sheet).
I am confused whether I can file a case in Consumer Forums because as per National Commission of Consumer Forums have held that students are not a consumer while some District Forums are taking cognizance of such type of cases even after orders of Supreme Court and National Commission. And also on the website of consumer helpline, students are recognised as a consumer.
So I wanted to know whether I could file a case against my university or not?

Bank not releasing original property documents.

Dear Sir,

We have switched our bank accounts, and the bank has charges us unjust closing /renewing charges, for which after protests, then bank has offered to waive off -50%.This offer was not accepted by us.

The bank is now holding on to our original documents given as collateral, and also not issuing a "NO DUES CERTIFICATE ", ,and they have verbally informed us that , we need to accept this 50% offer for release of documents and no dues certificates.

What is the recourse available to us, to release our property documents. The banking ombudsman, will not entertain any complaints, till one month has lapsed.

Please advise,
